Ordinance No. 5,264890427 -12 ORDINANCE NO. 5264 AN ORDINANCE DECLARING THAT AN EMERGENCY SITUATION EXISTS, AUTHORIZING THE PAYMENT OF THE SUM OF NINE THOUSAND EIGHT HUNDRED SEVENTY -FIVE AND N01100 ($9,875.00) DOLLARS TO COX AIR CONDITIONING FOR THE PURCHASE AND INSTALLATION OF TWO CARRIER AIR CONDITIONING COMPRESSORS AT CITY HALL; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF_ WHEREAS, the two Carrier air compressors at City Hall have suffered unforeseen damage; and WHEREAS, TEX.L.GOV'T.CODE ANN. 1 252.022, provides that in case of unforeseen damage to public machinery, equipment, or other property, the requirement for competitive bids is not applicable; and WHEREAS, informal bids for the purchase and installation of two Carrier air conditioning compressors at City Hall have been obtained, and Cox Air Conditioning, is the low bid; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby declares that an emergency situation exists. Section 2: That payment to Cox Air Conditioning of the sum of NINE THOUSAND EIGHT HUNDRED SEVENTY -FIVE AND N01100 ($9,875.00) DOLLARS for the purchase and installation of two Carrier air conditioning compressors at City Hall is hereby authorized. Section 3: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
