Ordinance No. 5,263890427 -11 ORDINANCE No. 5263 AN ORDINANCE AMENDING SECTIONS 27 -18(c) AND 27- 20.2(b) OF CHAPTER 27, °SUBDIVISIONS," OF THE CODE OF ORDINANCES AND ADDING SECTION 27- 73(c), °WATER AND SEWER SYSTEMS;" PROVIDING A REPEALING CLAUSE; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That Section 27-18(c) of the Code of Ordinances, City of Baytown, Texas, is hereby amended to read as follows: Sec. 27 -18. Departmental review (stage one). (c) Submission of required data. The required data shall be submitted to the Director of Planning and Traffic not less than eight (8) days prior to the Commission meeting at which preliminary approval is sought. Section 2: That Section 27- 20.2(b) of the Code of Ordinances, City of Baytown, Texas, is hereby amended to read as follows: Sec. 27 -20.2. Final approval (stage three). (b) The final plat shall be submitted to the Director of Planning and Traffic not less than eight (8) days prior to the Commission meeting at which final approval is sought. Section 3: That the Code of Ordinances, City of Baytown, Texas, is hereby amended by adding a section to be numbered Section 27- 73(c), "Water and Sewer Systems," which said section reads as follows: Sec. 27 -73. Water and sewer systems. (c) Water and sewer systems proposed for developments in the extraterritorial jurisdiction shall be in accordance with appropriate County standards and Texas Department of Health "Construction Standards for On -site Sewerage Facilities," effective January, 1988, or as periodically amended. Section 4: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. 890427 -11a Section 5: If any provisions, section, exception, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end all provisions of this ordinance are declared to be severable. Section G: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
