ORDINANCE NO. 5220
AN ORDINANCE DECLARING THAT AN EMERGENCY SITUATION
EXISTS, AUTHORIZING THE PAYMENT OF THE SUM OF FORTY -
SEVEN THOUSAND FIVE HUNDRED EIGHTY --FIVE AND N01100
($47,585.00) DOLLARS TO CHANNEL CONSTRUCTION COMPANY,
INC. FOR THE SLIPLINING OF THE SANITARY SEWER LINE NEAR
THE INTERSECTION OF NORTH MAIN AND BOB SMITH ROAD; AND
PROVIDING FOR THE EFFECTIVE DATE THEREOF.
WHEREAS, the sanitary sewer line near the intersection of
North Main and Bob Smith Road has suffered unforeseen damage, in
that 1523 feet of an 18 inch concrete sewer line has failed,
which is causing a potential health hazard; and
WHEREAS, TEX.L.GOV- T.CODE ANN. S 252.022 provides that in
case of unforeseen damage to public property, or when a
procurement is necessary to preserve or protect the public health
or safety of the citizens of the City, the requirement for
competitive bids is not applicable; and
WHEREAS, informal bids for the sliplining of this sewer line
have been obtained, and Channel Construction Company, Inc. is
the low bid; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the City Council of the City of Baytown,
Texas, hereby declares that an emergency situation exists.
Section 2: That payment to Channel Construction Company,
Inc. of the sum of FORTY -SEVEN THOUSAND FIVE HUNDRED EIGHTY -FIVE
AND NO /100 ($47,585.00) DOLLARS for this sliplining work is
hereby authorized.
Section 3: This ordinance shall take effect immediately
from and after its passage by the City Council of the City of
Baytown.
INTRODUCED, READ, and PASSED by the affirmative vote of the
City Council of the City of Baytown, this the 23rd day of
February, 1989.
