Ordinance No. 5,218890223 -8 ORDINANCE NO. 5218 AN ORDINANCE DETERMINING THAT THE PAYMENT OF TAXES BY BAKERS BAYTOWN HOLIDAY FOODS ON ACCOUNT NUMBER 9905 -034 -2705 FOR THE TAX YEAR 1987 WAS EXCESSIVE; APPROVING A REFUND OF THE OVERPAYMENT OF THREE THOUSAND SEVEN HUNDRED THIRTY --TWO AND 71/100 ($3,732.71) DOLLARS; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, Bakers Baytown Holiday Foods has applied for a refund of an overpayment of taxes on account number 9905 -034 -2705 for the tax year 1987 alleging a substantial error in the appraisal records; and WHEREAS, the Appraisal Review Board for the Harris County Appraisal District has found that the appraisal records for account number 9905 -034 -2705 were incorrect and has corrected the records to conform them to the requirements of law; and WHEREAS, the City Council of the City of Baytown, Texas, has determined that the January 31, 1988, payment of taxes on account number 9905- 034 -2705 by Bakers Baytown Holiday Foods was excessive in the amount of $3,732.71; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council hereby approves and authorizes payment of $3,732.71 to Bakers Baytown Holiday Foods as a refund of the excessive payment of taxes on account number 9905 -034 -2705 for the tax year 1987. Section 2: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
