ORDINANCE NO. 5210
AN ORDINANCE DECLARING THAT AN EMERGENCY SITUATION
EXISTS, AUTHORIZING THE PAYMENT OF THE SUM OF TWO
THOUSAND FIVE HUNDRED NINETY -SEVEN AND 76/100
($2,597.76) DOLLARS TO HAHN TRUCK SALES AND SERVICE
CORPORATION FOR THE REPAIR OF A LADDER ON AN AERIAL
TRUCK; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF.
WHEREAS, the ladder on Fire Department Unit 32 Aerial truck
has suffered unforeseen damage; and
WHEREAS, TEX.L.GOV- T.CODE ANN. S 252.022, provides that in
case of unforeseen damage to public machinery, equipment, or
other property, the requirement for competitive bids is not
applicable; and
WHEREAS, informal bids for the repair of a ladder on an
aerial truck have been obtained, and Hahn Truck Sales and Service
Corporation, is the low bid; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the City Council of the City of Baytown,
Texas, hereby declares that an emergency situation exists.
Section 2: That payment to Hahn Truck Sales and Service
Corporation of the sum of TWO THOUSAND FIVE HUNDRED NINETY -SEVEN
AND 76/100 ($2,597.76) DOLLARS for the repair of the ladder on an
aerial truck is hereby authorized.
Section 3: This ordinance shall take effect immediately
from and after its passage by the City Council of the City of
Baytown.
INTRODUCED, READ, and PASSED by the affirmative vote of the
City Council of the City of Baytown, this the 9th day of
February, 1989.
