Ordinance No. 5,209ORDINANCE NO. 5209 AN ORDINANCE DECLARING THAT AN EXISTS, AUTHORIZING THE PAYMENT THOUSAND EIGHT HUNDRED FORTY -TWO AND DOLLARS TO BAYTOWN SAND AND CLAY CONCRETE SAND; AND PROVIDING FOR THEREOF. 890209 -14 EMERGENCY SITUATION OF THE SUM OF TEN N01100 ($10,842.00) FOR THE PURCHASE OF THE EFFECTIVE DATE WHEREAS, due to the icy conditions which began Friday, February 3, 1989, the Public Works Department needed to purchase concrete sand to sand the various bridges and overpasses within the City, thereby providing its citizens safety and protecting public health; and WHEREAS, TEX.LOC.GOV- T.CODE ANN. S 252.022, provides that in case of procurements for the protection of public health or safety, the requirement for competitive bids is not applicable; and WHEREAS, concrete sand is the only material that would allow traction on ice and Baytown Sand and Clay was the only bidder; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby declares that an emergency situation exists. Section 2: That payment to Baytown Sand and Clay of the sum of TEN THOUSAND EIGHT HUNDRED FORTY --TWO AND NO/ 100 ($10,842.00) DOLLARS is hereby authorized. Section 3: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
