Ordinance No. 5,185890126 -1 ORDINANCE NO. 5185 AN ORDINANCE DISCONTINUING, ABANDONING FOR PUBLIC USE, AND CLOSING A PORTION OF PARK STREET LOCATED IN THE WILLIAM SCOTT SURVEY, ABSTRACT 66, BAYTOWN, HARRIS COUNTY, TEXAS; ABANDONING ALL INTEREST OF THE CITY OF BAYTOWN AND THE PUBLIC IN AND TO SAID PORTION OF SAID STREET; AND AUTHORIZING THE MAYOR TO EXECUTE AND THE CITY CLERK TO ATTEST AND DELIVER A CONVEYANCE TO THE ABUTTING OWNERS. WHEREAS, that portion of Park Street, lying within the corporate limits of the City of Baytown in Harris County, Texas, and described in Exhibit "A" is bounded on both sides by a large petro - chemical complex; and WHEREAS, citizens traveling on Park Street have the potential of being exposed to chemical spills or releases, fires, and other hazards associated with refining and chemical plant operations; and WHEREAS, Park Street is a narrow, shoulderless road which cannot be feasibly improved to reduce the risks to citizens using the road; and WHEREAS, Park Street is also subject to periodic flooding which blocks the road and endangers those using it; and WHEREAS, traffic counts have shown that over sixty percent of the traffic using Park Street is traffic related to the refinery and chemical operations on the abutting property; and WHEREAS, the recent improvements to Robert Lanier Drive and Baker Road have made Park Street a less desirable route for general traffic; and WHEREAS, upon conveyance of Park Street from Harris County to the City of Baytown, the City of Baytown will be responsible for the maintenance and repair of this road; and WHEREAS, the only known owners of property abutting or adjoining the above described portions of said streets desire that same be discontinued, closed and abandoned; and WHEREAS, the abutting owners have proposed giving other property to the City of Baytown in exchange for the described portion of Park Street, and the value of such other property, as determined by independent appraisal, is in excess of the appraised value of Park Street, and could be readily used for industrial development, thereby benefiting the City of Baytown and its taxpayers; and WHEREAS, it appears to be to the best interest of the City of Baytown, Harris County, Texas, that the above described 890126 -1a portion of said street be discontinued, closed and abandoned and it further appears that the interest of no other owners of property in the area or of the Public in general will be prejudiced or impaired thereby; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That upon receipt from Harris County of the above described portion of Park Street, lying within the corporate limits of the City of Baytown, Harris County, Texas, the same is hereby discontinued and abandoned for Public use, and the City of Baytown does for itself and for the Public abandon all interest in and to the above described portion of said street, and does hereby approve the request of the owners of the property abutting said portion of said street to acquire the abandoned portion of the street. Section 2: That the Mayor of the City of Baytown is hereby authorized and directed to execute and the City Clerk to attest and deliver an appropriate conveyance of said portion of Park Street to the owner or owners of property abutting same, upon receipt of proper compensation. Section 3: This abandonment and transfer of the above described portion of Park Street is contingent upon Harris County's transfer of Park Street to the City of Baytown, and none of the actions described above shall take effect until Park Street is conveyed to the City of Baytown by Harris County.
