ORDINANCE NO. 5185
AN ORDINANCE DISCONTINUING, ABANDONING FOR PUBLIC USE,
AND CLOSING A PORTION OF PARK STREET LOCATED IN THE
WILLIAM SCOTT SURVEY, ABSTRACT 66, BAYTOWN, HARRIS
COUNTY, TEXAS; ABANDONING ALL INTEREST OF THE CITY OF
BAYTOWN AND THE PUBLIC IN AND TO SAID PORTION OF SAID
STREET; AND AUTHORIZING THE MAYOR TO EXECUTE AND THE
CITY CLERK TO ATTEST AND DELIVER A CONVEYANCE TO THE
ABUTTING OWNERS.
WHEREAS, that portion of Park Street, lying within the
corporate limits of the City of Baytown in Harris County, Texas,
and described in Exhibit "A" is bounded on both sides by a large
petro - chemical complex; and
WHEREAS, citizens traveling on Park Street have the
potential of being exposed to chemical spills or releases, fires,
and other hazards associated with refining and chemical plant
operations; and
WHEREAS, Park Street is a narrow, shoulderless road which
cannot be feasibly improved to reduce the risks to citizens using
the road; and
WHEREAS, Park Street is also subject to periodic flooding
which blocks the road and endangers those using it; and
WHEREAS, traffic counts have shown that over sixty percent
of the traffic using Park Street is traffic related to the
refinery and chemical operations on the abutting property; and
WHEREAS, the recent improvements to Robert Lanier Drive and
Baker Road have made Park Street a less desirable route for
general traffic; and
WHEREAS, upon conveyance of Park Street from Harris County
to the City of Baytown, the City of Baytown will be responsible
for the maintenance and repair of this road; and
WHEREAS, the only known owners of property abutting or
adjoining the above described portions of said streets desire
that same be discontinued, closed and abandoned; and
WHEREAS, the abutting owners have proposed giving other
property to the City of Baytown in exchange for the described
portion of Park Street, and the value of such other property, as
determined by independent appraisal, is in excess of the
appraised value of Park Street, and could be readily used for
industrial development, thereby benefiting the City of Baytown
and its taxpayers; and
WHEREAS, it appears to be to the best interest of the City
of Baytown, Harris County, Texas, that the above described

portion of said street be discontinued, closed and abandoned and
it further appears that the interest of no other owners of
property in the area or of the Public in general will be
prejudiced or impaired thereby; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That upon receipt from Harris County of the
above described portion of Park Street, lying within the
corporate limits of the City of Baytown, Harris County, Texas,
the same is hereby discontinued and abandoned for Public use, and
the City of Baytown does for itself and for the Public abandon
all interest in and to the above described portion of said
street, and does hereby approve the request of the owners of the
property abutting said portion of said street to acquire the
abandoned portion of the street.
Section 2: That the Mayor of the City of Baytown is hereby
authorized and directed to execute and the City Clerk to attest
and deliver an appropriate conveyance of said portion of Park
Street to the owner or owners of property abutting same, upon
receipt of proper compensation.
Section 3: This abandonment and transfer of the above
described portion of Park Street is contingent upon Harris
County's transfer of Park Street to the City of Baytown, and none
of the actions described above shall take effect until Park
Street is conveyed to the City of Baytown by Harris County.
INTRODUCED, READ and PASSED by the affirmative vote of the
City Council of the City of Baytown, this the 26th day of
January, 1989.

BEING a public road traversing through the Exxon BAYTOWN REFINERY
known as PARK STREET, said road being 60 feet wide and 11,678 +/- feet in
length.
COMMENCING at a point in the center line of Goose Creek Stream, said
point being the Northeast corner of a 1466.44 -acre tract, known as EXXON FEE
NO. 2752, conveyed to HUMBLE OIL AND REFINING COMPANY (now known as Exxon) by
F. F. ARNIM by deed dated May 22, 1919, recorded in Volume 435, Page 413
of the DEED OF RECORDS OF HARRIS COUNTY, TEXAS, and having Exxon Refinery grid
coordinates of NORTH 15.528.007 and WEST 997.218;
THENCE, South 00 00' 20" East 1297.76 feet to a point in the north
right of way line of Decker Drive;
THENCE, South 00 00' 20" East 365.82 feet across Decker Drive to a
point;
THENCE, South of 00 00' 20" East 1050.28 feet to the POINT OF
BEGINNING of a 60 -foot -wide public road known as PARK STREET and being more
particularly described as follows;
THENCE, with said north right of way line, SOUTH 530 46' 51" West
5363.74 feet to a point;
THENCE, South 550 53' 43" West 1841.94 feet to a point;
THENCE, South 590 33' 52" West 1778.77 feet to a point;
THENCE, South 59° 40' 52" West 274.13 feet to a point;
THENCE, South 590 58' 20" West 2520.70 feet to a point, said point
