Ordinance No. 5,159AN ORDINANCE TEXAS, DELL, AUTHORIZING HUNDRED AND CONDITIONING CONDITIONER; ® THEREOF. 81129.-13 ORDINANCE NO. 5159 OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, NRING THAT AN EMERGENCY SITUATION EXISTS, THE PAYMENT OF THE SUM OF FOUR THOUSAND SIX N01100 ($4,600.00) DOLLARS TO COX AIR FOR THE REPAIR OF THE CITY HALL ANNEX AIR AND PROVIDING FOR THE EFFECTIVE DATE ********************************* * * * * * * * * * * * * * * * * * * * * * * * * * * * * * ** WHEREAS, the City Hall Annex air conditioner has suffered unforeseen damage; and WHEREAS, TEX.L.GOV'T.CODE ANN. S 252.022, provides that in case of unforeseen damage to public machinery, equipment, or other property, the requirement for competitive bids is not applicable; and WHEREAS, informal bids for the repair of the City Hall Annex air conditioner have been obtained, and Cox Air Conditioning, is the low bid; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby declares that an emergency situation exists. Section 2: That payment to Cox Air Conditioning of the sum of FOUR THOUSAND SIX HUNDRED AND N01100 ($4,600.00) DOLLARS for the repair of the City Hall Annex air conditioner is hereby authorized. Section 3: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
