ORDINANCE NO. 5159
OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
NRING THAT AN EMERGENCY SITUATION EXISTS,
THE PAYMENT OF THE SUM OF FOUR THOUSAND SIX
N01100 ($4,600.00) DOLLARS TO COX AIR
FOR THE REPAIR OF THE CITY HALL ANNEX AIR
AND PROVIDING FOR THE EFFECTIVE DATE

WHEREAS, the City Hall Annex air conditioner has suffered
unforeseen damage; and
WHEREAS, TEX.L.GOV'T.CODE ANN. S 252.022, provides that in
case of unforeseen damage to public machinery, equipment, or
other property, the requirement for competitive bids is not
applicable; and
WHEREAS, informal bids for the repair of the City Hall Annex
air conditioner have been obtained, and Cox Air Conditioning, is
the low bid; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the City Council of the City of Baytown,
Texas, hereby declares that an emergency situation exists.
Section 2: That payment to Cox Air Conditioning of the sum
of FOUR THOUSAND SIX HUNDRED AND N01100 ($4,600.00) DOLLARS for
the repair of the City Hall Annex air conditioner is hereby
authorized.
Section 3: This ordinance shall take effect immediately
from and after its passage by the City Council of the City of
Baytown.
INTRODUCED, READ, and PASSED by the affirmative vote of the
City Council of the City of Baytown, this the 29th day of
November, 1988.
