Ordinance No. 5,14181110 -2 ORDINANCE NO. 5141 ® AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, DETERMINING THAT THE PAYMENT OF TAXES BY BAYTOWN APARTMENTS, INC. ON ACCOUNTS NUMBERS 0960 - 005 -000 -0 AND 0960 - 005 -001 -0 FOR THE TAX YEAR 1987 WAS EXCESSIVE; APPROVING A REFUND OF THE OVERPAYMENT OF THREE THOUSAND NINE HUNDRED NINETY AND 20/100 ($3,990.20) DOLLARS; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, Baytown Apartments, Inc. has applied for a refund of an overpayment of taxes on accounts numbers 0960- 005 -000 -0 and 0960 - 005 -001 -0 for the tax year 1987 alleging a substantial error in the appraisal records; and WHEREAS, the Appraisal Review Board for the Harris County Appraisal District has found that the appraisal records for accounts numbers 0960 - 005 -000 -0 and 0960 - 005 -001 -0 were incorrect and has corrected the records to conform them to the requirements of law; and WHEREAS, the City Council of the City of Baytown, Texas, has determined that the January 29, 1988, payment of taxes on account number 0960 - 005 -000 -0 by Baytown Apartments, Inc. was excessive in the amount of ONE THOUSAND SIX HUNDRED FIFTY -TWO AND 32/100 ($1,652.32) DOLLARS; and WHEREAS, the City Council of the City of Baytown, Texas, has determined that the January 29, 1988, payment of taxes on account number 0960 - 005 -001 -0 by Baytown Apartments, Inc. was excessive in the amount of TWO THOUSAND THREE HUNDRED THIRTY -SEVEN AND 88/100 ($2,337.88) DOLLARS; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council hereby approves and authorizes payment of THREE THOUSAND NINE HUNDRED NINETY AND 20/100 ($3,990.20) DOLLARS to Baytown Apartments, Inc. as a refund of the excessive payment of taxes on accounts numbers 0960- 005 -000 -0 and 0960 - 005 -001 -0 for the tax year 1987. Section 2: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
