Ordinance No. 5,13981027 -8 ORDINANCE NO. 5139 AN ORDINANCE OF THE-CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, DECLARING THAT AN EMERGENCY SITUATION EXISTS, AUTHORIZING THE PAYMENT OF FOUR THOUSAND EIGHT HUNDRED AND N0 1100 ($4,800.00) DOLLARS TO JERRYCO MACHINE AND BOILER WORKS FOR THE REPAIR OF THE BOILER FOR THE CITY HALL AIR CONDITIONING/ HEATING UNIT; AND PROVIDING FOR ® THE EFFECTIVE DATE THEREOF. WHEREAS, the boiler for the City Hall air conditioning/ heating unit has suffered unforeseen damage; and WHEREAS, TEX.L.GOV'T.CODE ANN. S 252.022, provides that in case of unforeseen damage to public machinery, equipment, or other property, the requirement for competitive bids is not applicable; and WHEREAS, informal bids for the repair of the boiler for the City Hall air conditioning/ heating unit have been obtained, and Jerryco Machine and Boiler Works is the low bid; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: ® Section 1: That the City Council of the City of Baytown, Texas, hereby declares that an emergency situation exists. Section 2: That payment to Jerryco Machine and Boiler Works of FOUR THOUSAND EIGHT HUNDRED AND N01100 ($4,800.00) DOLLARS for repairs of the City Hall air conditioning/ heating unit is hereby authorized. Section 3: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
