ORDINANCE NO. 5084
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, AMENDING SECTION 2 -49, "MAKEUP OF COMMISSION,"
SECTION 2 -53, "POWERS AND DUTIES," AND SECTION 2 -54,
"MEETINGS," OF CHAPTER 2, "ADMINISTRATION," OF THE CODE
OF ORDINANCES; PROVIDING A REPEALING CLAUSE; CONTAINING
A SAVINGS CLAUSE; AND PROVIDING FOR THE EFFECTIVE DATE
HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That Chapter 2, "Administration," Section 2 -49,
of the Code of Ordinances, City of Baytown, Texas, is hereby
amended to read as follows:
Sec. 2 -49. Makeup of commission.
The makeup of the commission shall be
demographically representative of the City. Five (5)
members shall be appointed during odd - numbered years
and four (4) members shall be appointed during even -
numbered years. Such appointments shall coincide with
the terms served by the city council members.
Section 2: That Chapter 2, "Administration," Section 2 -53,
of the Code of Ordinances, City of Baytown, Texas, is hereby
amended to read as follows:
Sec. 2 -53. Powers and duties.
The commission shall have the power and shall be
required to:
(1) Make, amend, extend or add to the master plan for
the development of the city and recommend adoption
by city council.
(2) Review and recommend to the city council proposed
changes in all land development ordinances.
(3) Study plans and plats of proposed developments and
shall, within legal limits, approve such that meet
all the standards as required by the ordinances
regulating these developments.
(4) Perform all duties required under state law for
the Impact Fee Advisory Committee.

When proposed developments are properly submitted
for review, the commission shall meet not less than
once each month. Meetings shall be held at the city
hall, unless notice of change of meeting place is
published in a newspaper of general circulation in the
city.
Section 4: All ordinances or parts of ordinances
inconsistent with the terms of this ordinance are hereby
repealed; provided however, that such repeal shall be only to the
extent of such inconsistency and in all other respects this
ordinance shall be cumulative of other ordinances regulating and
governing the subject matter covered by this ordinance.
Section 5: If any provisions, section, exception,
subsection, paragraph, sentence, clause or phrase of this
ordinance or the application of same to any person or set of
circumstances, shall for any reason be held unconstitutional,
void or invalid, such invalidity shall not affect the validity of
the remaining provisions of this ordinance or their application
to other persons or sets of circumstances and to this end all
provisions of this ordinance are declared to be severable.
Section 6: This ordinance shall take effect immediately
from and after its passage by the City Council of the City of
Baytown.
