ORDINANCE NO. 5083
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, AMENDING DIVISION 5, "COMMUNITY DEVELOPMENT
ADVISORY COMMITTEE," OF CHAPTER 2, "ADMINISTRATION," OF
THE CODE OF ORDINANCES; PROVIDING A REPEALING CLAUSE;
CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE
EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That Chapter 2, Division 5, "Community
Development Advisory Committee," Section 2 -59 of the Code of
Ordinances, City of Baytown, Texas, is hereby amended to read as
follows:
Sec. 2 -59. Committee - Creation, membership,
appointment.
(a) There is hereby created a community
development advisory committee, hereafter referred to
as the committee, which shall consist of nine (9)
members. The members of this board shall be residents
of the city and shall be appointed by city council.
(b) The committee shall have representation of
low -to- moderate income areas of the city (as defined by
the Department of Housing and Urban Development).
Minority groups will at least be represented in
proportion to such city -wide percentage representation.
The committee shall consist of at least one (1) member
from each of the six (6) council districts.
(c) Members shall be appointed in January of each
year for a two -year term. Five members shall be
appointed in odd numbered years and four members
appointed in even numbered years. No committee member
shall serve more than two terms. A member appointed to
complete the unexpired term of a previous member shall
be deemed to have served a full term upon completion of
the unexpired term.
(d) The committee may establish its own rules as
to the attendance of its members to its meetings, and
in furtherance of such the committee may, by a majority
vote, expel any member who, in the opinion of the
committee, misses an unreasonable number of meetings.
® All members shall serve at the pleasure of city
council.
Section 2: That Chapter 2, Division 5, "Community
Development Advisory Committee," Section 2 -60, of the Code of

9 Ordinances, City of Baytown, Texas, is hereby amended to read as
follows:
Sec. 2 -60. Same - Powers and duties.
The committee shall hold such public hearings and
make reports as required in the Citizen Participation
Plan.
Section 3: That Chapter 2, Division 5, "Community
Development Advisory Committee," Section 2 -61, of the Code of
Ordinances, City of Baytown, Texas, is hereby amended to read as
follows:
Sec. 2 -61. City community development planner.
The city community development planner shall serve as ex-
officio secretary of the board and shall perform the following
services:
(a) Keep the minutes, books, files and records of the
committee.
(b) Send out all notices and attend to all correspondence
pertaining to the grant program.
9' (c) Assist the board.
(d) Prepare and present a written quarterly report to city
council which summarizes the activities of the committee and the
status of the budget.
Section 4: All ordinances or parts of ordinances
inconsistent with the terms of this ordinance are hereby
repealed; provided however, that such repeal shall be only to the
extent of such inconsistency and in all other respects this
ordinance shall be cumulative of other ordinances regulating and
governing the subject matter covered by this ordinance.
Section 5: If any provisions, section, exception,
subsection, paragraph, sentence, clause or phrase of this
ordinance or the application of same to any person or set of
circumstances, shall for any reason be held unconstitutional,
void or invalid, such invalidity shall not affect the validity of
the. remaining provisions of this ordinance or their application
to other persons or sets of circumstances and to this end all
provisions of this ordinance are declared to be severable.
Section 6: This ordinance shall take effect immediately
® from and after its passage by the City Council of the City of
Baytown.
