THE CITY COUNCIL OF THE CITY OF BAYTOWN,
3 ORDINANCE NO. 5042 ADOPTED JUNE 23,
THE CONTRACT FOR COMMUNITY DEVELOPMENT
PROJECT NO. 87 -10F TO J. ALLEN CONTRAC-
SUM OF TWO THOUSAND SIX HUNDRED TEN AND
® N01100 ($2,610.00) DOLLARS; AND PROVIDING FOR THE
EFFECTIVE DATE HEREOF.
WHEREAS, by Ordinance No. 5042 adopted June 23, 1988, the
City Council of the City of Baytown, Texas, did award the
contract for Community Development Rehabilitation Project No.
87 -10F; and
WHEREAS, the low bidder is unable to meet certain of the
contract requirements; and
WHEREAS, the second low bidder, J. Allen Contractors, can
fulfill the contractual requirements specified in the original
bid; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That Ordinance No. 5042 adopted June 23, 1988,
is hereby repealed.
Section 2: That the City Council of the City of Baytown
hereby accepts the bid of J. Allen Contractors for the sum of TWO
THOUSAND SIX HUNDRED TEN AND N01100 ($2,610.00) DOLLARS for
Community Development Rehabilitation Project No. 87 -10F, being
the foundation raising and leveling of the house at 1106 Carver,
providing that final payment will not be made to said contractor
until completion and acceptance of the work by the owner and the
Baytown Community Development Program.
Section 2: That pursuant to the provisions of
TEX.L.GOV'T.CODE ANN. § 252.048, the City Manager is hereby
granted general authority to approve any change order involving a
decrease or an increase in costs of Five Thousand and No /100
($5,000.00) Dollars or less, provided that the original contract
price may not be increased by more than ten (10 %) percent or
decreased by more than twenty -five (25 %) percent without the
consent of the contractor to such decrease.
Section 3: This ordinance shall take effect immediately
® from and after its passage by the City Council of the City of
Baytown.
