ORDINANCE NO. 5046
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, DECLARING THAT AN EMERGENCY SITUATION EXISTS,
AUTHORIZING THE PAYMENT OF THE SUM OF FOUR THOUSAND FIVE
HUNDRED FIFTY -FIVE AND 20/100 ($4,555.20) DOLLARS TO
MUNICIPAL PIPE AND FABRICATING COMPANY FOR THE PURCHASE
OF 1,460 FEET OF SIX -INCH .WATER PIPE; AND PROVIDING FOR
THE EFFECTIVE DATE HEREOF.
WHEREAS, numerous leaks have been found in approximately
1,460 feet of a six -inch water line on E. Fayle Street; and
WHEREAS, the necessity to protect public health and continue
water service for the citizens of Baytown on E. Fayle Street
requires the replacement of 1,460 feet of a six -inch water line;
and
WHEREAS, TEX.LOC.GOV'T.CODE ANN. 9 252.022, provides that in
case of procurements for the protection of public health or
safety, the requirement for competitive bids is not applicable;
and
WHEREAS, informal bids for the purchase of 1,460 feet of a
six -inch C -900 water pipe have been obtained, and Municipal Pipe
and Fabricating Company is the low bidder; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the City Council of the City of Baytown,
Texas, hereby declares that an emergency situation exists.
Section 2: That payment to Municipal Pipe and Fabricating
Company of the sum of FOUR THOUSAND FIVE HUNDRED FIFTY -FIVE AND
20/100 ($4,555.20) DOLLARS is hereby authorized.
Section 3: This ordinance shall take effect immediately
from and after its passage by the City Council of the City of
Baytown.
INTRODUCED, READ, and PASSED by the affirmative vote of the
City Council of the City of Baytown, this the 23rd day of June,
1988.
