AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, REPEALING ORDINANCE NO. 4992 ADOPTED APRIL 28,
1988; AWARDING THE CONTRACT FOR COMMUNITY DEVELOPMENT
REHABILITATION PROJECT NO. 87 -04 TO PALTON CONSTRUCTION
FOR THE SUM OF ELEVEN THOUSAND THREE HUNDRED FIFTY -ONE
® AND N01100 ($11,351.00) DOLLARS; AND PROVIDING FOR THE
EFFECTIVE DATE HEREOF.
WHEREAS, by Ordinance No. 4992 adopted April 28, 1988, the
City Council of the City of Baytown, Texas, did award the
contract for Community Development Rehabilitation Project No.
87 -04; and
WHEREAS, the low bidder has failed to honor his contract and
that contract was terminated by the City of Baytown on June 14,
1988; and
WHEREAS, the second low bidder, Palton Construction, can
fulfill the contractural requirements specified in the original
bid; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
Is TEXAS:
Section l: That Ordinance No. 4992 adopted April 28, 1988,
is hereby repealed.
Section 2: That the City Council of the City of Baytown
hereby accepts the bid of Palton Construction for the sum of
ELEVEN THOUSAND THREE HUNDRED FIFTY -ONE AND N01100 ($11,351.00)
DOLLARS for Community Development Rehabilitation Project No.
87 -04, being the repair and rehabilitation of 121 Granville,
providing that final payment will not be made to said contractor
until completion and acceptance of the work by the owner and the
Baytown Community Development Program.
Section 2: That pursuant to the provisions of
TEX.L.GOV'T.CODE ANN. § 252.048, the City Manager is hereby
granted general authority to approve any change order involving a
decrease or an increase in costs of Five Thousand and No /100
($5,000.00) Dollars or less, provided that the original contract
price may not be increased by more than ten (10 %) percent or
decreased by more than twenty -five (25 %) percent without the
consent of the contractor to such decrease.
® Section 3: This ordinance shall take effect immediately
from and after its passage by the City Council of the City of
Baytown.
