ORDINANCE NO. 5030
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, DECLARING THAT AN EMERGENCY SITUATION EXISTS,
AUTHORIZING THE PAYMENT OF THE SUM OF TWO THOUSAND NINE
HUNDRED THIRTY -FIVE AND 72/100 ($2,935.72) DOLLARS TO
HIGHWAY EQUIPMENT FOR THE PURCHASE OF PARTS TO REPAIR A
® GRADALL; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF.
WHEREAS, a Gradall has suffered unforeseen damage; and
WHEREAS, TEX.L.GOV'T.CODE ANN. S 252.022, provides that in
case of unforeseen damage to public machinery, equipment, or
other property, the requirement for competitive bids is not
applicable; and
WHEREAS, informal bids for the purchase of parts for repair
of this equipment have been obtained, and Highway Equipment is
the low bid; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:

1: That the City Council of the City of Baytown,
declares that an emergency situation exists.
2: That payment to Highway Equipment of the sum of
NINE HUNDRED THIRTY -FIVE AND 72/100 ($2,935.72)
reby authorized.
Section 3: This ordinance shall take effect immediately
from and after its passage by the City Council of the City of
Baytown.
INTRODUCED, READ, and PASSED by the affirmative vote of the
City Council of the City of Baytown, this the 9th day of June,
1988.
