Ordinance No. 5,029ORDINANCE NO. 5029 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN AUTHORIZING CHANGE ORDER NO. 17 TO THE CONTRACT WITH. BASIC CONSTRUCTORS FOR THE CENTRAL DISTRICT EPA GRANT PROJECT (CONTRACT NO. 1) . BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council does hereby authorize Change Order No. 17 to the Contract with Basic Constructors for the Central District EPA Grant Project (Contract No. 1). A copy of said change order is attached hereto, marked Exhibit "A," and made a part hereof for all intents and purposes. Section 2: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown. PROJECT: Construction of Central Sewer District Wastewater Treatment Plant EPA Project No. C- 48- 1498 -03 Job No. 044 -33, Contract No. 1 ORIGINAL CONTRACT AMOUNT: $5,378,600.00 Dear Mayor and City Council: Your approval is requested on the following modifications and /or changes to subject project. These added costs will be applied to the above Contract. Description 1. Replacement of severely deteriorated rectangular tank sludge collector mechanism for Chlorine Con- tact Chamber Quiescent Basins No. 1 and No. 2 in accordance with the attached technical specifica- tion (Item No. S105 - Rectangular Tank Sludge Collector Mechanism and Special Provision No. 1 to Item No. S105) and the attached drawing (Sheet No. 38A of 67 entitled Exist. Chlorine Contact Chamber Quies. Basins No. 1 and No. 2 (Sections and Details) and all applicable contractual requirements. Due to the long delivery time for receiving this ® particular equipment the Contract Conditions are amended as follows: C7 Cost n Ell I u Change Order No. 17 044 -33 #1 June 3, 1988 Page 2 Description ® 1. City will dewater and remove sludge from each basin; only one basin will be out of service at any time. First basin to be ready for Con- tractor's equipment installation within five working days after equipment is delivered to jobsite. 2. Contractor shall complete installation includ- ing manufacturer's check -out, field painting, electrical connections, etc. within five weeks after equipment is delivered to the job site. 3. The amount of time required to order and receive the required equipment is currently unknown. Therefore, the extension of time required for performing this Change Order No. 17 cannot be specifically set forth as a given number of calendar days; rather, it is con- nected to equipment delivery as set forth in 2. above. 4. This extension of time applies only for Change Order No. 17. 5. Contract completion date for all work, exclud- ing Change Order No. 17, will be in accordance with Contractural Requirements. 6. Warranty of equipment, materials, and workman- ship for all work, excluding Change Order No. 17, will be in accordance with Contractural Requirements. Warranty for Change Order No. 17 will be for one year after all the work required by Change Order No. 17 has been complete. 7. Upon completion of work, excluding Change Order No. 17, and acceptance of the work by the City Council of the City of Baytown, and subject to the approval of the Contractor's security, the retainage will be reduced to One Thousand Dollars ($1,000.00). The retainage, ® plus the sum due under this change order will be paid in full to the Contractor when Change Order No. 17 has been completed and accepted by the City Council of the City of Baytown.
