AN ORDINANCE REGULATING PLUMBING WORK IN THE CITY OF
BAYTOWN, TEXAS, DEFINING CERTAIN TERMS; PROVIDING FOR
CERTAIN EXEMPTIONS; PROVIDING FOR THE ENFORCEMENT OF
® THIS ORDINANCE AND THE ISSUANCE OF PERMITS AND
ESTABLISHING CERTAIN FEES; PROVIDING FOR SPECIFICATIONS,
MATERIALS AND METHODS OF PLUMBING INSTALLATIONS;
PROVIDING PENALTIES FOR VIOLATION OF THIS ORDINANCE;
REPEALING INCONSISTENT ORDINANCES; PROVIDING A SAVINGS
CLAUSE; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE
DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That Chapter 24, "Plumbing," of the Code of
Ordinances, City of Baytown, Texas, is hereby amended to read as
follows:
Sec. 24 -1. Plumbing code adopted.
The Examination Plumbing Code and Study Guide by the
Texas State Board of Plumbing Examiners, as published
on the date of adoption of this ordinance, and all
amendments thereto, and new editions thereof,
heretofore or hereafter adopted, of which at least one
copy is to be on file in the office of the City Clerk
of the City of Baytown, is hereby adopted as the
plumbing code of the City of Baytown. A copy of said
code is attached hereto and made a part of for all
intents and purposes. All references to City in said
Code shall mean the City of Baytown, and the intent and
purposes set forth in said code are expressly affirmed
and adopted.
Sec. 24 -2. Amendments, deletions and modifications.
[The plumbing code adopted in Section 24 -1 is hereby
amended in the following respects:]
Section 8.3.3 is hereby repealed and a new Section
8.3.3 reading as follows is hereby added:
Section 8.3.3. Advisory responsibility of the board.
® The board shall submit to the city council such
recommendations for the improvement and revision of
this code and such recommendations for deviations
' from this code for trial of new materials, methods
or techniques, as it may from time to time deem

41 necessary and proper in light of the development of
new materials, methods or techniques which would
result in a better and more economical installation.
All requests for use of materials or methods not
covered in this code shall be fully supported by
® factual evidence, or prior approval, from a
recognized testing agency or such impartial
qualified authority acceptable to the board.
Subsection 9.2.2, "Table of Fees," is hereby
repealed and a new subsection 9.2.2 is hereby adopted
that reads as follows:

Section 12.1.3 is hereby repealed and a new section
12.1.3 reading as follows is hereby added:
Section 12.1.3. Materials not listed.
Materials other than those listed for the various
uses may be permitted upon approval of the plumbing
appeals and advisory board. The board shall not
approve any material unless the same is shown to be
® equal to or better than materials listed in this
ordinance.

board and approval of council. The board, for this
purpose, shall not recommend any material unless
same is shown to be equal to or better than
materials listed in this ordinance.
Section 12.1.4, "Material and uses," shall be
amended by the deletion of bituminized sewer pipe as
listed in this section.
Sec. 24 -3. Violations and penalty.
An offense under this chapter is a misdemeanor and
any person who shall violate any provision of this
chapter shall, upon conviction, be punished by a fine
not to exceed TWO THOUSAND AND N01100 ($2,000.00)
DOLLARS. Each day of the continuance of such violation
shall be considered a separate offense and each and
every day shall constitute a separate offense and each
and every day shall constitute a separate violation..
This penalty provisions replaces and supercedes any
penalty provision contained within the plumbing code.
Section 2: All ordinances or parts of ordinances
inconsistent with the terms of this ordinance are hereby
repealed; provided however, that such repeal shall be only to the
extent of such inconsistency and in all other respects this
ordinance shall be cumulative of other ordinances regulating and
governing the subject matter covered by this ordinance.
Section 3: If any provisions, section, exception,
subsection, paragraph, sentence, clause or phrase of this
ordinance or the application of same to any person or set of
circumstances, shall for any reason be held unconstitutional,
void or invalid, such invalidity shall not affect the validity of
the remaining provisions of this ordinance or their application
to other persons or sets of circumstances and to this end all
provisions of this ordinance are declared to be severable.
Section 4: Any person who shall violate any provision of
this ordinance shall be deemed guilty of a misdemeanor and upon
conviction shall be punished by a fine of not more than TWO
THOUSAND AND N01100 ($2,000.00) DOLLARS.
Section 5: This ordinance shall take effect from and after
ten (10) days from its passage by the City Council. The City
Clerk is hereby directed to give notice hereof by causing the
caption of this ordinance to be published in the official
® newspaper of the City of Baytown at least twice within ten (10)
days after passage of this ordinance.
