Ordinance No. 4,96980324 -23 ORDINANCE NO. 4969 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, DECLARING THAT AN EMERGENCY SITUATION EXISTS, AUTHORIZING THE PAYMENT OF THE SUM OF SEVEN THOUSAND EIGHT HUNDRED FIFTY AND N01100 ($7,850.00) DOLLARS TO CHANNEL CONSTRUCTION COMPANY, INC. FOR SLIPLINING REPAIR OF A TEN (10) INCH SANITARY SEWER LINE SERVING THE CIVIC CENTER; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. WHEREAS, smoketesting revealed numerous leaks in a ten (10) inch concrete sanitary sewer line paralleling the north bank of the waterway separating the Civic Center and Norman C. Foote Park; and WHEREAS, emergency repairs of such ten (10) inch concrete sanitary sewer line are necessary to keep the sanitary sewer system in operation and protect public health; and WHEREAS, TEX.LOC.GOV'T.CODE ANN. 5 252.022, provides that in case of procurements for the protection of public health or safety, the requirement for competitive bids is not applicable; and WHEREAS, informal bids for the sliplining repair of a ten (10) inch sanitary sewer line have been obtained, and Channel Construction Company, Inc. is the low bidder; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby declares that an emergency situation exists. Section 2: That payment to Channel Construction Company, Inc. of the sum of SEVEN THOUSAND EIGHT HUNDRED FIFTY AND N01100 ($7,850.00) DOLLARS is hereby authorized. Section 3: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
