ORDINANCE NO. 4963
® AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, PROVIDING THAT A PORTION OF UTILITY EASEMENT BE
VACATED, ABANDONED AND CLOSED; PROVIDING FOR THE
QUITCLAIMING OF THE CITY'S INTEREST IN SAID PROPERTY;
AND PROVIDING FOR THE EFFECTIVE DATE HEREOF.
WHEREAS, there is a portion of a certain dedicated utility
easement which runs along the part of Lot 20, Block 4, of
Ringsbend, Section 2; and
WHEREAS, John S. Goodenough and wife, H. R. Goodenough, are
the abutting land owners and have made application that a portion
of such utility easement be discontinued, closed and abandoned as
a utility easement; and
WHEREAS, John S. Goodenough and wife, H. R. Goodenough, have
offered ONE HUNDRED FIFTY AND N01100 ($150.00) DOLLARS for the
value of a portion of the utility easement; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: The portion of the utility easement to be
abandoned is described as a 3 foot wide and 55.65 foot long
utility easement. A map of the portion of such utility easement
to be abandoned is attached hereto and marked Exhibit "A."
Section 2: That portion of the dedicated utility easement
described above is hereby closed, abandoned, and permanently
vacated as a dedicated utility easement.
Section 3: That the City of Baytown hereby accepts as the
value for such portion of utility easement, payment by John S.
Goodenough and wife, H. R. Goodenough, of the sum of ONE
HUNDRED FIFTY AND N01100 ($150.00) DOLLARS.
Section 4: That the interest or interests of the City
and /or public in the portion of the above described utility
easement (and as shown in Exhibit "A" attached hereto) is hereby
quitclaimed to the adjacent owner for and in consideration of
exchange for equal or greater value.

LEGAL DESCRIPTION OF THE SECTION OF EASEMENT
AT 3611 CANTERBURY TO BE ABANDONED BY THE CITY OF BAYTOWN
BEGINNING at a point on the south right -of -way line of Canterbury Street in
Baytown, Texas, said point being the northwest property corner of Lot 20,
Block 4 of the replat of Kings Bend Subdivision, Section 2 as shown in
Volume 183, page 25 of the map records of Harris County, Texas, said lot
also being 3611 Canterbury Street,
THENCE S 06 29'19 "E a distance of 101.72 feet along the west property line
of the above described lot to a point, said point being the intersection
with the north edge of a 16 foot wide utility easement running parallel with
the rear property line of the above mentioned lot, said point also being the
POINT OF BEGINNING for the property described below,
THENCE N 80 18151 11E a distance of approximately 55.31 feet along the north
edge of the existing 16 foot utility easement to a point, said point being
the western edge of a 10 foot utility easement running parallel to the east
property line of the above mentioned lot,
THENCE S 09 29'31 "E a distance of 3.00 feet to a point,
��► THENCE S 80 18'51 "W a distance of approximately 55.65 feet to a point on the
west property line of the aforementioned lot,
THENCE N 06 29119 11W a distance of about 3.00 feet along the west property
line of said lot to the POINT OF BEGINNING, encompasing an area of 166.44
square feet more or less.
