Ordinance No. 4,96380324 -17 ORDINANCE NO. 4963 ® AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, PROVIDING THAT A PORTION OF UTILITY EASEMENT BE VACATED, ABANDONED AND CLOSED; PROVIDING FOR THE QUITCLAIMING OF THE CITY'S INTEREST IN SAID PROPERTY; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. WHEREAS, there is a portion of a certain dedicated utility easement which runs along the part of Lot 20, Block 4, of Ringsbend, Section 2; and WHEREAS, John S. Goodenough and wife, H. R. Goodenough, are the abutting land owners and have made application that a portion of such utility easement be discontinued, closed and abandoned as a utility easement; and WHEREAS, John S. Goodenough and wife, H. R. Goodenough, have offered ONE HUNDRED FIFTY AND N01100 ($150.00) DOLLARS for the value of a portion of the utility easement; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: The portion of the utility easement to be abandoned is described as a 3 foot wide and 55.65 foot long utility easement. A map of the portion of such utility easement to be abandoned is attached hereto and marked Exhibit "A." Section 2: That portion of the dedicated utility easement described above is hereby closed, abandoned, and permanently vacated as a dedicated utility easement. Section 3: That the City of Baytown hereby accepts as the value for such portion of utility easement, payment by John S. Goodenough and wife, H. R. Goodenough, of the sum of ONE HUNDRED FIFTY AND N01100 ($150.00) DOLLARS. Section 4: That the interest or interests of the City and /or public in the portion of the above described utility easement (and as shown in Exhibit "A" attached hereto) is hereby quitclaimed to the adjacent owner for and in consideration of exchange for equal or greater value. Section 5: authorized to such abandonment ® Section 6: from and after 0 Baytown. That the Mayor and City Clerk are hereby execute such instruments, if any, necessary for and sale.
