Ordinance No. 4,94880324 -2 4948 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, is TEXAS, AMENDING CHAPTER 31, "UTILITIES," SECTION 31 -54, BY ADDING SUBSECTION (e) TO PROVIDE FOR THE FORM OF DEPOSITS; REPEALING CONFLICTING ORDINANCES; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. L�********************************* * * * * * * * * * * * * * * * * * * * * * * * * * * * * * ** BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That Chapter 31, "Utilities," is hereby amended by adding a subsection, to be numbered Section 31- 54(e), which said section reads as follows: Sec. 31 -54. Water deposits and refunds. (e) Form of deposits. (1) Deposits of less than $500.00 shall be cash deposits in the form of cash, check or money order. (2) Deposits of $500.00 or more for commercial consumers, apartment houses, mobile home parks 4D or other multi - family dwelling projects shall be by cash, or irrevocable bank letter of credit, or an assignment of security. An irrevocable bank letter of credit must be drawn on an FDIC insured bank located within Harris or Chambers County, Texas, and shall be for a period of not less than one year. Any security pledged in an assignment of security shall be approved by the utility office manager and placed in an FDIC insured bank located within Harris or Chambers County, Texas. Section 2: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 3: If any provisions, section, exception, subsection, paragraph, sentence, clause or phrase of this ® ordinance or the application of same to any person or set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end all provisions of this ordinance are declared to be severable. n .7 i 80324 - 2a ' Section 4: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
