ORDINANCE NO. 4947
® AN ORDINANCE PROVIDING FOR THE EXTENSION OF CERTAIN
BOUNDARY LIMITS OF THE CITY OF BAYTOWN, TEXAS, AND THE
ANNEXATION OF THE LANDING AT CEDAR BAYOU AND ADJACENT
AREA, WHICH SAID TERRITORIES LIE ADJACENT TO AND ADJOIN
THE PRESENT BOUNDARY LIMITS FOR THE CITY OF BAYTOWN,
TEXAS.
WHEREAS, there being no request for an "on-site" hearing,
two public hearings before the City Council of the City of
Baytown, Texas, where all interested persons were provided with
an opportunity to be heard on the proposed annexation of the
property described in Section 1 of this ordinance, were held, one
at 7:00 p.m. and the other at 7:15 p.m., on the 25th day of
February, 1988, in the City Council Chamber of the City Hall of
the City of Baytown, Texas, which date is not more than forty
(40) nor less than twenty (20) days prior to the institution of
annexation proceedings; and
WHEREAS, notices of such public hearings were published in a
newspaper having general circulation in the City of Baytown,
Texas, and in the below described territories on the 14th day of
February, 1988, which date is not more than twenty (20) nor less
than ten (10) days prior to the date of such public hearings; and
WHEREAS, the total corporate area of the City of Baytown,
Texas, on the 1st day of January, 1988, was 29.58 square miles;
and
WHEREAS, the population of the City of Baytown, Texas, is
approximately 60,472 inhabitants; and
WHEREAS, the below described territories lie within the
extraterritorial jurisdiction of the City of Baytown, Texas; and
WHEREAS, the below described territories lie adjacent to and
adjoin the City of Baytown, Texas; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the following described land and
territories lying adjacent to and adjoining the City of Baytown
are hereby added and annexed to the City of Baytown, Texas, and
shall hereinafter be included within the boundary limits of the
City of Baytown, Texas, and present boundary limits of such City,
at the various points contiguous to the areas hereinafter
® described, are altered and amended so as to include said areas
® within the corporate limits of the City of Baytown, Texas, to -
wit:

Section 2: The above described territories and the areas so
annexed shall be a part of the City of Baytown, Texas, and the
property so added hereby shall bear its pro rata of the taxes
levied by the City of Baytown, Texas, and the inhabitants thereof
shall be entitled to all of the rights and privileges of all the
citizens of the City of Baytown and shall be bound by the acts,
ordinances, resolutions, and regulations of the City of Baytown,
Texas.
Section 3: In accordance with TEX.REV.CIV.STAT., art. 970a,
and TEX.L.GOV'T.CODE ANN. § 43.056, as amended, the service plan
prepared by the City for providing municipal services to the
annexed areas is attached as Exhibit "B" and is hereby approved.
Section 4: This ordinance shall be published and passed in
the manner provided in Article 1, Section 9, of the Charter of
the City of Baytown, Texas.

SUMMARY
The area proposed for annexation consists of approximately 95.493 acres.
Public hearings on the annexation are scheduled for February 25, 1988,
at 7:00 p.m. and 7:15 p.m. in the Council Chambers of the Baytown City
Hall, 2401 Market Street.
The annexation will be accomplished off of a ten foot strip in the east
right-of-way of S.H. 146.
Attached are the specific Service Plan elements of the major Departments
that will primarily provide service for the new area.
Included as a part of this plan are a location map and field notes of the
annexation.
As a result of this annexation, no additional city facilities, vehicles or personnel
will be required.

0 Fire Department
Fire Station Number 6 will respond to all calls in this annexation. Existing
hydrants and fire lines in the development appear to be sufficient size.
The developer will be required to connect to an existing line at either
Massey-Tompkins/N. Alexander or in the Tierra del Oro subdivision, located
across Cedar Bayou Stream. No new facilities, vehicles or personnel
will be necessary as a result of annexation.
Police Department
This area will be assigned to Patrol District 2B. The annexation will
necessitate annexing approximately 1840 feet of SH.146 right-of-way.
This action will not require any new facilities, personnel or vehicles.
Public Works
Sewer Service is currently available from a six inch line that goes through
a lift station to Raccoon Drive.
Storm drainage will be to Cedar Bayou Stream.
Access will be provided via SH. 146
Solid waste collection will be on Tuesdays and Fridays.
No new personnel or vehicles will be required as a result of this annexation,
but the developer will be required to provide a six inch water line
that will become the city's responsibility. This is the same fire line discussed
under the Fire Department.
Other Department Requirements
The annexed area will be required to meet all city building code and
health code enforcement, including flood plain regulations. Chambers.
County is in the flood plain management program.
Police and Fire protection as well as public works collections and services
will be implemented upon completion of annexation procedures.

PUBLIC WORKS SERVICE PLAN
S1. Area being annexed: The Landing at Cedar Bayou.
2. The party requesting the annexation of this area will be responsible
for providing: sufficient water line connecting the Landing to existing
® city water lines, that will serve this area. All improvements required
will be in accordance with the appropriate City of Baytown regulations,
and the construction will be inspected as it progresses.
When available, the engineering plans showing the details of construction
will be available for inspection in the City Engineer's office, if any.
Water service will be available for the area from an existing water well;
the developer proposes to install a (6) six inch line from the City's
existing line.
There is/iaxxxk sufficient water capacity to serve the area, but not for
fire service.
Sewer service will be available for the area from an existing 6 inch line
and lift station that is located in the subdivision pumping to Raccoon Dr.
There is/iaxxxk sufficient treatment plant capacity to serve the area.
3. Storm drainage will be to Cedar Bayou.
4. Street access will be provided from State Hwy 146.
S. The maintenance of all required newly constructed improvements will
commence on the date of acceptance of these improvements.
6. Public Works aatbl/wil.l not require additional personnel and equipment.
The requirements of any, are attached hereto as Exhibit "A".
7. Solid waste collection will be provided by adding this area to the
northeast route. This service will commence upon annexation.
