Ordinance No. 4,93480310 -2 ORDINANCE NO. 4934 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, DECLARING THAT AN EMERGENCY SITUATION EXISTS, AUTHORIZING THE PAYMENT OF THE SUM OF ELEVEN THOUSAND TWO HUNDRED FIFTEEN AND N01100 ($11,215.00) DOLLARS TO CHANNEL CONSTRUCTION COMPANY, INC. FOR THE SLIPLINING OF THE SANITARY SEWER LINE IN THE EASEMENT BETWEEN BRITTON STREET AND MISSISSIPPI STREET; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. WHEREAS, the sanitary sewer line in an easement between Britton Street and Mississippi Street has suffered unforeseen damage, in that 290 feet of an 8 inch concrete sewer line has failed, which is causing a potential health hazard; and WHEREAS, TEX.L.GOV'T.CODE ANN. § 252.022 provides that in case of unforeseen damage to public property, or when a procurement is necessary to preserve or protect the public health or safety of the citizens of the City, the requirement for competitive bids is not applicable; and WHEREAS, informal bids for the sliplining of this sewer line have been obtained, and Channel Construction Company, Inc. is the low bid; NOW THEREFORE, ® BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby declares that an emergency situation exists. Section 2: That payment to Channel Construction Company, Inc. of the sum of ELEVEN THOUSAND TWO HUNDRED FIFTEEN AND N01100 ($11,215.00) DOLLARS for this sliplining work is hereby authorized. Section 3: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
