ORDINANCE NO. 4925
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, AUTHORIZING THE PAYMENT OF THE SUM OF TWO
THOUSAND TWO HUNDRED THIRTY -ONE AND N01100 ($2,231.00)
DOLLARS TO AUTOMATIC PUMP AND EQUIPMENT COMPANY AS THE
SOLE SOURCE FOR A HYDROMATIC SUBMERSIBLE PUMP; AND
PROVIDING FOR THE EFFECTIVE DATE HEREOF.
WHEREAS, the lift station in Whispering Pines, (4817 Lonely
Pine), has only one pump working; and
WHEREAS, the second pump was removed and found unrepairable;
and
WHEREAS, TEX.L.GOV'T.CODE ANN. 5 252.022 provides that when
the functional requirements of the City can only be satisfied by
one source, the requirement for competitive bids is not
applicable; and
WHEREAS, the procurement of a hydromatic submersible pump
can be satisfied by only one source, Automatic Pump and Equipment
Company, NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the City Council of the City of Baytown,
Texas, hereby declares that only one source can satisfy the needs
of the City for a hydromatic submersible pump.
Section 2: That payment to Automatic Pump and Equipment
Company, as the sole source, of TWO THOUSAND TWO HUNDRED THIRTY -
ONE AND N01100 ($2,231.00) DOLLARS as payment for the above
described hydromatic submersible pump is hereby authorized.
Section 3: This ordinance shall take effect immediately
from and after its passage by the City Council of the City of
Baytown.
