Ordinance No. 4,914Published In: THE BAYTOWN SUN 80128 -5 Tuesday, February 2, 1988 Wednesday, February 3, 1988 ORDINANCE NO. 4914 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, ESTABLISHING A PRIMA FACIE SPEED LIMIT DURING CONSTRUCTION ON A PORTION OF DECKER DRIVE (SPUR 330) FROM LOOP 201 TO THE CITY LIMITS DURING CONSTRUCTION; PRESCRIBING A MAXIMUM PENALTY OF TWO HUNDRED AND NO /100 ($200.00) DOLLARS FOR EACH VIOLATION THEREOF; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE HEREOF. WHEREAS, the State Department of Highways and Public Transportation has made it known to the City of Baytown that operations will begin in the near future to rehabilitate Decker Drive (Spur 330) from Loop 201 to the city limits on the west, and WHEREAS, in the interest of safety, it is desirable to maintain a construction speed zone during the construction period and hours; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That a prima facie speed zone of 40 mph be is, established on Decker Drive (Spur 330) from the city limits to Wade Road during construction to be effective when so signed within said zone. Section 2: That a prima facie speed zone of 35 mph be established on Decker Drive (Spur 330) from Wade Road to Loop 201 during construction to be effective when so signed within said zone. Section 3: That during construction, necessary signs for posting the speed zones will be furnished, installed, and maintained by the direction of the State Department of Highways and Public Transportation Engineer in charge of the project. Section 4: This ordinance shall be in effect only during the period of construction, and only during the hours of actual construction, and completion of this project shall automatically cancel the speed zones. Section 5: Any person who shall violate any provision of this ordinance shall be deemed guilty of a misdemeanor and upon ® conviction shall be punished by a fine of not less than One and N01100 ($1.00) Dollar nor more than Two Hundred and No /100 ($200.00) Dollars except .minors who have passed their 14th birthday but have not reached their 17th birthday shall be ® punished by a fine of not more than One Hundred and No /100 �` ( $100 .00) Dollars .
