Ordinance No. 4,858Published In: THE BAYTOWN -SUN Tuesday, Nov. 17, 1987 Wednesday, Nov. 18, 1987 ORDINANCE NO. 4858 71112 -4 ® AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, CHANGING THE INTERSECTION OF CEDAR BAYOU ROAD AT CEDAR BAYOU ROAD /McKINNEY ROAD FROM A STOP INTERSECTION ® TO A YIELD INTERSECTION; AUTHORIZING THE POSTING OF THE PROPER SIGNS; REPEALING CONFLICTING ORDINANCES; PRESCRIBING A MAXIMUM PENALTY OF TWO HUNDRED AND N01100 ($200.00) DOLLARS FOR EACH VIOLATION THEREOF; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That pursuant to the provisions of Section 18 -10 of the Code of Ordinances, the intersection of Cedar Bayou Road at Cedar Bayou Road /McKinney Road is hereby changed from a stop intersection to a yield intersection. ® Section 2: The Director of Planning and Traffic is authorized and directed to change the above described intersection from a stop intersection to a yield intersection by placement of the appropriate signs. Section 3: If any provisions, section, exception, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end all provisions of this ordinance are declared to be severable. Section 5: Any person who shall violate any provision of this ordinance shall be deemed guilty of a misdemeanor and upon conviction shall be punished by a fine of not less than One and No /100 ($1.00) Dollar nor more than Two Hundred and No /100 ($200.00) Dollars except minors who have passed their 14th birthday but have not reached their 17th birthday shall be punished by a fine of not more than One Hundred and No /100 ($100.00) Dollars. Section 5: This ordinance shall take effect from and after ® ten (10) days from its passage by the City Council. The City Clerk is hereby directed to give notice hereof by causing the caption of this ordinance to be published in the official newspaper of the City of Baytown at least twice within ten (10) days after passage of this ordinance. r 1 U E E INTRODUCED, City Council of November, 1987.
