Ordinance No. 4,84671022 -4 ® ORDINANCE NO. 4846 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, DECLARING THAT AN EMERGENCY SITUATION EXISTS, ® AUTHORIZING THE PAYMENT OF THE SUM OF TWO THOUSAND EIGHT HUNDRED NINETY -FIVE AND N01100 ($2,895.00) DOLLARS TO YOUNG PLUMBING AND HEATING COMPANY FOR A REPLACEMENT GENERATOR FOR THE AIR CONDITIONING SYSTEM AT STERLING MUNICIPAL LIBRARY; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. WHEREAS, the air conditioning system at Sterling Municipal Library has suffered unforeseen damage; and WHEREAS, Tex.Loc.Gov't.Code Ann. sec. 252.022, provides that in case of unforeseen damage to public machinery, equipment, or other property, the requirement for competitive bids is not applicable; and WHEREAS, informal bids for the replacement of this equipment have been obtained, and Young Plumbing and Heating Company is the low bid; NOW THEREFORE, ® BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby declares that an emergency situation exists. Section 2: That payment to Young Plumbing and Heating Company for the sum of TWO THOUSAND EIGHT HUNDRED NINETY -FIVE AND N01100 ($2,895.00) DOLLARS for replacement of the generator for the air conditioning system at Sterling Municipal Library is C:1:30:17 hereby authorized. Section 3: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
