ORDINANCE NO. 4833
AN ORDINANCE DISCONTINUING, ABANDONING FOR PUBLIC USE,
AND CLOSING A PORTION OF CASEY STREET, CHERRY STREET,
AND HOLLY STREET, ADJACENT TO AND BETWEEN BLOCKS 1, 2,
AND 3 IN CASEY ADDITION SUBDIVISION, ACCORDING TO THE
® MAP OR PLAT THEREOF RECORDED IN VOLUME 532, PAGE 27, OF
THE DEED RECORDS OF HARRIS COUNTY, TEXAS; ABANDONING AND
QUITCLAIMING ALL INTEREST OF THE CITY OF BAYTOWN AND THE
PUBLIC IN AND TO SAID PORTIONS OF SAID STREETS; AND
AUTHORIZING THE MAYOR TO EXECUTE AND THE CITY CLERK TO
ATTEST AND DELIVER CONVEYANCE TO THE ABUTTING OWNERS.
WHEREAS, the following described portions of Casey Street,
Cherry Street, and Holly Street, between Blocks 1, 2, and 3 of
Casey Addition Subdivision, lying within the corporate limits of
the City of Baytown in Harris County, Texas, according to the Map
or Plat thereof recorded in Volume 532, Page 27, of the Deed
Records of Harris County, Texas, are not now used by the Public:
TRACT 1
A parcel of land described as follows:
BEGINNING at the southeast corner of Lot 12, Block 1,
of the Casey Addition Subdivision in Baytown, Harris
40 County, Texas;
THENCE in a westerly direction 700 feet along the north
right-of-way line of Casey Street and its extension
across the intersection with Holly Street and Cherry
Street to the Southeast corner of Lot 12, Block 3,
Casey Addition subdivision;
THENCE in a southernly direction perpendicular to the
right -of -way line of Casey Street a distance of 50 feet
to the south right -of -way line of Casey Street;
THENCE in an easterly direction 700 feet along the
south right -of -way line of Casey Street to its
intersection of the right -of -way of McKinney Road;
THENCE 50 feet in a northernly direction along an
extension of the west right -of -way line of McKinney
Road to the POINT OF BEGINNING, being a tract of
approximately 35,000 square feet.

A parcel of land described as follows:
BEGINNING at the southwest corner of Lot 7, Block 1,
® Casey Addition Subdivision, Baytown, Harris County,

THENCE northerly 200 feet along the east right -of -way
line of Holly Street to the northwest corner of Lot 6,
Block 1, Casey Addition Subdivision;
® THENCE 50 feet in a westerly direction along an
extension of the south right -of -way line of Cedar Bayou
Road to a point at the northeast corner of Lot 1, Block
2, Casey Addition Subdivision;
THENCE 200 feet in a southernly direction along the
west right -of -way line of Holly Street to the southeast
corner of Lot 12, Block 2, Casey Addition Subdivision;
THENCE 50 feet in an easterly direction along an
extension of the north Casey Street right -of -way line
to the POINT OF BEGINNING, being a tract of
approximately 10,000 square feet.
T RAC T 3
A parcel of land described as follows:
BEGINNING at the southwest corner of Lot 7, Block 2,
Casey Addition Subdivision, Baytown, Harris County,
Texas;
THENCE northerly 200 feet along the east right -of -way
line of Cherry Street to the northwest corner of Lot 6,
Block 2, Casey Addition Subdivision;
THENCE 50 feet in a westerly direction along an
extension of the south right -of -way line of Cedar Bayou
Road to a point at the northeast corner of Lot 1, Block
3, Casey Addition Subdivision;
THENCE 200 feet in a southernly direction along the
west right -of -way line of Cherry Street to the
southeast corner of Lot 12, Block 3, Casey Addition
Subdivision;
THENCE 50 feet in an easterly direction along an
extension of the north Casey Street right -of -way line
to the POINT OF BEGINNING, being a tract of
approximately 10,000 square feet.
® WHEREAS, no interest of the public requires that said
portions of said streets be improved or kept open; and
WHEREAS, the interest of the public will be benefited by the
termination of any obligation on the part of the City of Baytown
to maintain said portions of said streets as a public right -of-
ways; and

® WHEREAS, the only known owners of property abutting or
adjoining the above described portions of said streets have made
application that same be discontinued, closed and abandoned; and
® WHEREAS, it appears to be to the best interest of the City
of Baytown, Harris County, Texas, that the above described
portions of said streets be discontinued, closed and abandoned,
and that the dedications made in connection with said map or plat
of Casey Addition Subdivision of record aforesaid, be cancelled
and held for naught insofar as the same apply to and affect the
above described portions of said streets, and it further appears
that the interest of no other owners of property in said Casey
Addition Subdivision or of the Public in general will be
prejudiced or impaired thereby; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the above described portions of Casey
Street, Cherry Street, and Holly Street in the Casey Addition
Subdivision, lying within the corporate limits of the City of
Baytown, Harris County, Texas, according to the map or plat
thereof recorded in Volume 532, Page 27, of the Map Records of
Harris County, Texas, be and the same is hereby discontinued and
abandoned for Public use, and the City of Baytown does for itself
and for the Public abandon and quitclaim all interest in and to
the above described portions of said streets, and does hereby
approve the application of said owners of the property abutting
said portions of said streets.
Section 2: That the Mayor of the City of Baytown is hereby
authorized and directed to execute and the City Clerk to attest
and deliver and appropriate conveyance of said portions of Casey
Street, Cherry Street, and Holly Street to the owner or owners of
property abutting same, upon receipt of proper compensation.
Section 3: This ordinance shall take effect immediately
from and after its passage by the City Council of the City of
Baytown.
INTRODUCED, READ and PASSED by the affirmative vote of the
City Council of the City of Baytown, this the 5th day of October,
1987.
