ORDINANCE NO. 4800
AN ORDINANCE APPROVING THE ADDITIONAL EMERGENCY REPAIRS
NECESSARY TO RESTORE THE SEWER LINE AND MANHOLE ON BOB
SMITH ROAD; AUTHORIZING FINAL PAYMENT TO SOLESBEE
® CONSTRUCTION COMPANY FOR THE REPAIR OF SEWER LINES AND A
MANHOLE ON BOB SMITH ROAD; AND PROVIDING FOR THE
EFFECTIVE DATE HEREOF.
WHEREAS, the City of Baytown contracted with Solesbee
Construction Company for the emergency repair of sewer lines and
a manhole on Bob Smith Road; and
WHEREAS, due to unstable soil conditions and the discovery
of additional needed repairs, the contractor was required to do
additional emergency work beyond that originally bid in order to
protect the public from possible health hazards resulting from
the damaged sewer line; and
WHEREAS, all the said repairs necessary to restore the sewer
line to service have been performed and completed in full
accordance..•-witli. -the terms and conditions of the aforesaid
contract; and
® WHEREAS , the City Engineer has
approved and accepted the
work and has heretofore issued his Certificate of Final
Acceptance and has certified same to the City Council and
recommended that it accept and receive said work and repairs as
constructed and completed by Contractor; and
WHEREAS, there remains due and owing to the said contractor
the sum of THIRTY -ONE THOUSAND TWO HUNDRED- SEVEN AND 73/100
($31,207.73) DOLLARS, NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the City Council hereby declares that
an emergency exists and approves the additional work required to
complete the repairs to the sewer line and manhole on Bob Smith
Road.
Section 2: That the City Council hereby accepts and
approves the above described work and repairs, and finds and
determines that all of said improvements have been completed in
full accordance with all of the terms and provisions of the
aforesaid contract.

Section 3: That the Certificate of Final Acceptance
heretofore issued by the City Engineer and certified to the City
Council is hereby accepted and received.
Section 4: That final payment to the said contractor in
the amount of THIRTY -ONE THOUSAND TWO HUNDRED SEVEN AND 73/100
($31,207.73) DOLLARS, is hereby authorized.
Section 5: This ordinance shall take effect immediately
from and after its passage by the City Council of the City of
Baytown.
INTRODUCED, READ and PASSED by the affirmative vote of the
City Council of the City of Baytown, this 10th day of September,
1987.
