ORDINANCE NO. 4785
AN ORDINANCE AUTHORIZING THE CITY ATTORNEY TO MARE
OFFERS FOR AND ON BEHALF OF THE CITY OF BAYTOWN TO THE
OWNERS OR OTHER PARTIES IN INTEREST FOR THE ACQUISITION
OF CERTAIN TRACTS DESCRIBED HEREIN REQUIRED FOR PARK
PURPOSES; REQUIRING THAT SUCH OFFERS BE ACCEPTED WITHIN
FIFTEEN (15) DAYS; DIRECTING THE CITY ATTORNEY TO
INSTITUTE CONDEMNATION PROCEEDINGS IN THE EVENT SUCH
OFFERS ARE REFUSED; AND PROVIDING FOR THE EFFECTIVE DATE
HEREOF.
WHEREAS, the City Council of the City of Baytown now finds
and determines that public convenience and necessity require that
the City of Baytown acquire the tracts described below; NOW
THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1; That the City Attorney is hereby authorized and
directed to make the offers listed below to the below named
owners, or other parties in interest believed to be the true
owners of said property or to the actual real and true owners
thereof, whether correctly named or not, for the purchase and
acquisition by the City of Baytown of the fee interest in the
said tracts that are required for park purposes within the City
of Baytown:
SEE ATTACHED EXHIBIT "A" AND "B"
Section 2: Such offers shall provide that if the offers
should not be accepted within fifteen (15) days after receipt,
the City of Baytown will consider such offers refused and will
institute condemnation proceedings on behalf of the City of
Baytown under any applicable provisions of the law, whether
provided by Chapter 21 of the Texas Property Code, Chapter 251 of
the Local Government Code, the Charter of the City of Baytown, or
any other provisions.
Section 3: Should such offers be accepted, the money above
set forth shall be paid out of any appropriation heretofore made
for the public purposes for which the above described tracts are
required. Should such offers not be accepted, the amount finally
awarded to the owners in the condemnation proceeding, plus costs,
fees, and expenses, shall be paid out of such funds so
appropriated.

FIELD :TOTES; BAYLAND ORPHANAGE TRACT TO THE CITY OF BAYTOIIN
TRACT one of two tracts of land l /ing in the 14illiam Scott Upper League, A -66, Baytown,
Harris County, Texas, and being a part of the C. W. Harrell tract recorded in Volume 220,
at Page 436, of the Harris County Deed Records, and being more particularly described by
metes and bounds as follows:
TRACT ONE
COMMENCING at the point of intersection of the east right of way line of
Wyoming Street with the north right of way line of State Highway 146;
THENCE South 0 °03'38" West across the State Highway 146 right of way a
distance of 319.48 feet to a point located in the south right of way .
line of State Highway 146;
THENCE South 89 °54'00" West with the south right of way line of the State
Highway a distance of 905.42 feet to a point of intersection marked by
a 1 3/4 inch galvanized iron pipe;
THENCE South 72 003'00" West continuing with the south right of way line
of the State Highway, a distance of 278.30 feet to the POINT OF BEGINNING
of Tract One, marked by a 2 inch galvanized iron pipe;
® THENCE South 47 050'00" East with the northeasterly line of the herein
described tract a total distance of 2137.41 feet, passing at 44.10 feet
from dry land to submerged land, passing at 1361.10 feet from submerged
land to dry land, passing at 2041.41 feet from dry land to submerged land;
and continuing 96.00 feet on submerged land to the terminus in Goose Creek
Stream and being the northeast corner of this tract;
THENCE South 12 °56'08" East on submerged land in Goose Creek Stream, a
distance of 397.30 feet to a_point for the southeast corner of this tract
marked by a 2 inch galvanized iron pipe;
THENCE North 47 °50'00" West with the southwesterly line of this tract a
total distance of 2593.80 feet, passing at 466.96 feet from submerged land
to dry land, passing at 1174.26 feet from dry land to submerged land,
passing at 2104.61 feet a 2 inch galvanized iron pipe marking the northeast
corner of a 10.0000 acre tract conveyed to Frank Angel from M. C. Bray,
et al, by deed recorded in the Harris County Deed Records, passing at 2245.55
feet from submerged land to dry land, and continuing on dry land 348.25
feet to the terminus lying in the south right of way line of State Highway
146 and being marked by a 2 inch galvanized iron pipe;
® THENCE North 72 °03'00" East with the south right of way line of State
Highway 146 a distance of 262.00 feet to the POINT OF BEGINNING of Tract
One, enclosing a parcel of land containing 12.3388 acres, more or less,
of which 4.5934 acres is dry land and 7.7454 acres is submerged land.
