ORDINANCE NO. 4782
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, DECLARING THAT AN EMERGENCY SITUATION EXISTS,
AUTHORIZING THE PAYMENT OF THE SUM OF FIVE THOUSAND SIX
HUNDRED SEVENTY -THREE AND 75/100 ($5,673.75) DOLLARS TO
CHANNEL CONSTRUCTION COMPANY, INC. FOR THE CLEANING AND
® TELEVISION INSPECTION OF SEWER LINES ON BOB SMITH ROAD;
AND PROVIDING FOR THE EFFECTIVE DATE HEREOF.
WHEREAS, the failure of a sewer line on Bob Smith Road
required that certain lines in that area be cleaned and inspected
by television in order to determine needed repairs; and
WHEREAS, TEX.REV.CIV.STAT., art. 2368a provides that in case
of procurements for the protection of public health of the
citizens of the City, or in the case of unforeseen damage to
public property, the requirement for competitive bids is not
applicable; and
WHEREAS, Channel Construction Company, Inc. was available
and able to perform this emergency work; and
WHEREAS, the failure to inspect and repair the damaged sewer
lines would result in a possible threat to the public health of
the citizens of the City; NOW THEREFORE,
® BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the City Council of the City of Baytown,
Texas, hereby declares that an emergency situation exists.
Section 2: That payment to Channel Construction Company,
Inc. of the sum of FIVE THOUSAND SIX HUNDRED SEVENTY -THREE AND
75.100 ($5,673.75) DOLLARS as payment for the above described
cleaning and television inspection of sewer lines.
Section 3: This ordinance shall take effect immediately
from and after its passage by the City Council of the City of
Baytown.
INTRODUCED, READ, and PASSED by the affirmative vote of the
City Council of the City of Baytown, this the 13th day of August,
1987.
