AN ORDINANCE AMENDING CHAPTER 11, "ELECTRICAL CODE," OF
THE CODE OF ORDINANCES OF THE CITY OF BAYTOWN BY
AMENDING SECTION 11 -2, "DUTY TO HOLD EXAMINATIONS;
® REQUIREMENTS FOR EXAMINATIONS;" SECTION 11 -24, "MASTER
ELECTRICIANS;" SECTION 11 -25, "MASTER SIGN ELECTRICIAN;"
SECTION 11 -26, MAINTENANCE ELECTRICIANS LICENSES;"
SECTION 11 -27, "JOURNEYMAN'S ELECTRICIAN'S LICENSE;"
SECTION 11 -29, RENEWALS AND DUPLICATES;" SECTION 11 -30,
"MARKING OF VEHICLES;" SECTION 11 -48, "TO WHOM PERMITS
TO BE ISSUED;" SECTION 11 -61, "FEES;" SECTION 11 -73, "
REQUIREMENTS ENUMERATED;" PROVIDING A REPEALING CLAUSE;
CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE
PUBLICATION AND EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That Section 11. -2(c) of the Code of Ordinances
of the City of Baytown, Texas, is hereby amended to read as
follows:
Section 11 -2. Duty to hold examination; requirements
® for examinations.
(c) Every person desiring a license under the terms of
this Chapter is required to present proof of
qualification as the Board may require. Among the
qualifications for the various licenses shall be
considerations as follows:
(1) [Master electrician.] Master Electricians
shall be electrical engineers with two (2)
years practical experience in the electrical
contracting industry, or four (4) years
electrical experience in some related
industry. A journeyman with four (4) years
journeyman experience in electrical
construction industry shall also be
considered to qualify for examination for
master electrician's license.
(2) [Journeyman electrician.]
® a. Apprentices applying for the journeyman
electrician's license who shall have
successfully completed an
apprenticeship in a four year
apprenticeship program which is
approved by both the U. S. Board of
Apprenticeship and Training and the
State of Texas may be given a

journeyman's license without further
examination; or
b. Apprentices applying for the journeyman
electrician's license who have a
® minimum of four (4) years electrical
experience, and who pass a City of
Baytown Journeyman Electrician's
Examination, may be given a
journeyman's license;
C. If the applicant for the journeyman
electrician's license can produce proof
of three (3) years of journeyman
experience as verified by a county,
state or municipal body and a master
electrician who has employed him in the
past, he may be given a journeyman's
license without further examination to
determine his qualifications.
Section 2: That Section 11 -24(d) of the Code of Ordinances
of the City of Baytown, Texas, is hereby amended to read as
follows:
Section 11 -24. Master electrician.
® d. Issuance fee. The electrical board shall grant
licenses and issue certificates therefor to all
applicants who shall make a passing grade of
seventy (70) on said examination, provided that in
no case shall a license be granted until after
payment by the applicant of the fee of one hundred
fifty ($150.00) dollars to the building permit
clerk. Renewal fee shall be one hundred ($100.00)
dollars.
Section 3: Section 11 -25(c) of the Code of Ordinances
of the City of Baytown, Texas, is hereby amended to read as
follows:
Section 11 -25. Master sign electrician.
(c) Issuance and fee. Before delivery of any master
sign contractor's license, the applicant shall pay
to the building permit clerk a fee of seventy -five
($75.00) dollars renewals fees shall be fifty
($50.00) dollars.
Section 4: That Section 11 -26(b) of the Code of
Ordinances of the City of Baytown, Texas, is hereby amended
to read as follows:

Section 11 -26. Maintenance electrician's license.
(b) [Fee.] The first license for a maintenance
electrician shall be fifteen ($15.00) dollars and
a renewal fee for said license shall be ten
® ($10.00) dollars. The examination fee of fifteen
($15.00) dollars shall be required.
Section 5: That Section 11 -27.of the Code of Ordinances of
the City of Baytown, Texas, is hereby amended to read as follows:
Section 11 -27. Journeyman's electrician license.
(a) [Scope of license; renewal dates; examination fee.]
Journeyman electrician's license shall require the
holder thereof to do work as an electrician under the
holder of a master electrician or a master sign
electrician license. An examination fee of fifteen
($15.00) dollars shall be paid to the building permit
clerk.
(b) [License fee.] The first license for a journeyman
electrician shall be fifteen ($15.00) dollars and the
renewal fee shall be ten ($10.00) dollars.
(c) [Temporary license.]
® (1) A journeyman's temporary license may be issued
for a period of sixty (60) days upon proof that
the applicant has successfully completed
apprenticeship in a four (4) year apprenticeship
program or has a valid journeyman license issued
by a county, state, or municipal body. A fee of
two ($2.00) dollars shall be charged for such
temporary permit.
(2) Application for a normal journeyman's license
must be made at the time of application for a
temporary license. City Inspector shall present
all temporary license applications to the
electrical board for review and approval at the
first regularly scheduled or specially called
meeting of the board. Such action shall be
considered a regular agenda item.
(3) A temporary license shall be revoked if the
holder thereof fails to apply for a journeyman's
® license, fails to timely register for the next
journeyman's examination, fails to take the next
journeyman's examination or fails the
journeyman's examination.
® Section 6: That Section 11 -29 of the Code of Ordinances of
the City of Baytown, Texas, is hereby amended to read as follows:

Sec. 11 -29. Renewals and duplicates.
All licenses and certificates issued by the electrical
board under the provisions of this Chapter shall be valid
for the remainder of the year in which they are issued and
® for the following year, expiring on December 31st of such
second year. Thereafter, the licenses and certificates
issued by the electrical board, under the provisions of this
Chapter, shall be issued for two years and shall expire on
December 31st of the second year.
Electricians' licenses shall be renewed by the
electrical board upon application and payment of the
required fee. It is further provided that no license which
shall lapse for as long as six (6) months shall be renewed
except upon examination.
In the event of loss of any types certificate, a
duplicate certificate may be issued by the electrical board
after payment of a fee of fifty ($.50) cents. All fees
shall be paid to be building permit clerk.
Section 7: That Section 11 -30 of the Code of Ordinances of
the City of Baytown, Texas, is hereby amended to read as follows:
Sec. 11 -30. Marking of vehicles.
® All trucks and /or vehicles used by master electricians
and master sign electricians, in the performance of their
work, must have the business name and license number affixed
to each side of such trucks and /or vehicles with two inch
letters. The names and numbers herein required shall be
located so that they will be clearly visible.
Section 8: That Section 11748 of the Code of Ordinances of
the City of Baytown, Texas, is hereby amended to read as follows:
Sec. 11 -48. To whom permits to be issued.
Permits shall be issued only to holders of the proper
electrician's license or electrical sign contractor's
license or person performing work on his /her own home. Any
master electrician requesting the issuance of permits for
the benefit of an electrical contracting company shall
verify that he is the owner of the company or firm or that
he has been in its employment for a minimum of ninety (90)
days. Such proof of employment shall be by cancelled
® payroll check or by the master electrician filing a letter
with the City stating the name of the new company at least
ninety (90) days before filing a request for a permit.
Section 9: That Section 11 -61 of the Code of Ordinances of
the City of Baytown, Texas, is hereby amended to read as follows:

Section 10: That Section 11 -73 of the Code of Ordinances of
the City of Baytown, Texas, is hereby amended to read as follows:
Sec. 11 -73. Requirements enumerated.
(a) All electrical construction and all materials and
appliances used in connection with the installation,
maintenance and operation of electrical wiring,
apparatus or equipment for the utilization of
electrical energy for light, heat or power, inside the
limits of the City shall conform to its special rules
and regulations as may be embodied in this Chapter and
to the published rules and regulations of the National
Electrical Code as currently revised, and the
Electrical Public Utility Company's meter loop
specifications. Evidence that electrical equipment is
suitably safe to persons and property is solely based
upon Underwriters' Laboratories, Inc. approval.
(b) When changes or additions are being made to existing
electrical installations, they shall conform to the
0 provisions of this Chapter.

(c) All unused electrical equipment within or on public or
private buildings or premises shall be removed if such
equipment, in the opinion of the electrical inspector,
constitutes a hazard or danger to life or property.
® (d) Service entrance switches or any service equipment
shall not be installed within a bathroom, toilet,
clothes closet or any inaccessible location.
(e) All service equipment shall be grounded to a driven
electrode meeting the requirements of the National
Electrical Code. A grounding conductor shall also be
Connected from the driven electrode to the water piping
system of the building.
(f) Service connections made on a temporary basis may be
disconnected by Houston Lighting and Power upon request
of inspector without written notice to contractor or
owners.
(g) All new residences with central heating and /or air
conditioning units in attics shall have a twenty -four-
inch walkway with a minimum of thirty -six (36) inches
vertical clearance to the controls side of the unit.
There shall be a light near the unit with a controlling
switch within six (6) feet of stairway and such switch
must be readily accessible.
(h) All wires in partitions shall be at least eighteen
inches from any plumbing or separated by stud or
stapled two inch clearance.
(i) Attic wiring shall require stapled two inch clearance
from any plumbing.
(j) Bell -type transformers primary connection must be
connected in a junction box with transformer fastened
to said box and made accessible to authorized person.
(k) Electrical metallic tubing will not be permitted in
contact with the ground, buried in the ground or
encased or covered by concrete which is in direct
contact to ground.
(1) All conductors within six (6) feet of an attic scuttle
hole or a stairway landing must be guarded from
® physical damage.
(m) All temporary construction poles will require a permit
fee as a meter loop and shall meet Houston Lighting and
Power Company's specifications.
(n) Approved metallic raceways such as rigid conduit,
electrical metallic tubing, and under floor cast -in-

place raceways, shall be required for all wires used to
conduct a current for lights, heat or power, and the
wiring of all buildings hereafter constructed, as well
as additions to any buildings within fire limits areas,
® Nos. 1 and 2, as they are now or may hereafter be
established, and in apartment houses of more than four
(4) apartments, churches, schools, hotels, theaters,
all commercial buildings, and other places of public
assembly.
(o) All new residences with an overhanging eave exceeding
twelve inches and less than ten feet from ground level
shall have a roof mast type service entrance riser
except where underground service is provided.
(p) The electrical inspector may, with the approval of City
Council, authorize installations of special wiring
methods.
(q) Aluminum conductors may not be used in any branch
circuit wiring.
(r) All underground feeders for commercial and multi -
occupancy buildings shall be in conduit and covered
with a minimum of two (2) inches of red concrete at a
depth specified by the National Electrical Code.
(s) All underground feeders for single family and two
family dwellings shall be in two inch or larger rigid
conduit, either rigid steel galvanized or Schedule 40
polyvinyl chloride conduit installed at a depth as
specified by the National Electrical Code. The rigid
conduit shall be terminated, approximately one foot
from the power company slab or housing. The conductors
shall be approved for direct burial.
(t) Temporary saw poles installed to supply construction
power shall not be connected to the permanent interior
wiring of buildings and or other structures without
first obtaining written permission from the electrical
Inspector. If such condition is found to exist without
prior written permission, the electrical inspector may
cause the immediate disconnection of service, and
without further notice to anyone.
This shall also include poles which may be classified
® as permanent.
Section 11: All ordinances or parts of ordinances
inconsistent with the terms of this ordinance are hereby
repealed, provided however, that such repeal shall be only to the
extent of such inconsistency and in all other respects this
ordinance shall be cumulative of other ordinances regulating and
governing the subject matter covered by this ordinance.

Section 12: If any provision, section, exception,
subsection, paragraph, sentence, clause or phrase of this
ordinance or the application of same to any person or set of
® circumstances, shall for any reason be held unconstitutional,
void or invalid, such invalidity shall not affect the validity of
the remaining provisions of this ordinance or their application
to other persons or sets of circumstances and to this end all
provisions of this ordinance are declared to be severable.

Section 13: This Ordinance shall take effect from and after
ten (10) days from its passage by the City Council. The City
Clerk is hereby directed to give notice hereof by causing the
caption of this ordinance to be published in the official
newspaper of the City of Baytown at least twice within ten (10)
days after the passage of this ordinance.
INTRODUCED, READ, and PASSED by the affirmative vote of the
