Ordinance No. 4,76170723 -4 ORDINANCE NO. 4761 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, DECLARING THAT AN EMERGENCY SITUATION EXISTS, AUTHORIZING THE PAYMENT OF THE SUM OF FOURTEEN THOUSAND FIVE HUNDRED AND N01100 ($14,500.00) DOLLARS TO SOLESBEE CONSTRUCTION COMPANY FOR THE SLIPLINING OF THE SANITARY SEWER LINE ON BOB SMITH ROAD; AND'PROVIDING'FOR THE EFFECTIVE DATE HEREOF. WHEREAS, the sanitary sewer line along Bob Smith Road has suffered unforeseen damage, in that additional leaks have been discovered, which is causing a potential health hazard; and WHEREAS, the discovery of additional leaks has caused the current repair work to be stopped, leaving Bob Smith Road closed; and WHEREAS, TEX.REV.CIV.STAT., art. 2368a provides that in case of unforeseen damage to public property, or when a procurement is necessary to preserve or protect the public health or safety of the citizens of the City, the requirement for competitive bids is not applicable; and WHEREAS, informal bids for the sliplining of this sewer line have been obtained, and Solesbee Construction Company is the low bid; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby declares that an emergency situation exists. Section 2:. the sum of FOURT: DOLLARS for this Section 3: from and after Baytown. That payment to Solesbee Construction Company of EEN THOUSAND FIVE HUNDRED AND N01100 ($14,500.00) sliplining work is hereby authorized. This ordinance shall take effect immediately its passage by the City Council of the City of INTRODUCED, READ, and PASSED by the affirmative vote of the City Council of the City of Baytown, this the 23rd day of July, 1987. ® METT 0.
