AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR TO
EXECUTE AND THE CITY CLERK TO ATTEST TO AN AMENDMENT TO
® THE CONTRACT WITH THE BAYTOWN AREA /WEST CHAMBERS COUNTY
ECONOMIC DEVELOPMENT FOUNDATION TO PROVIDE MARINA
DEVELOPMENT SERVICES; AUTHORIZING THE PAYMENT OF THIRTY
THOUSAND AND N01100 ($30,000.00) DOLLARS FOR SUCH
SERVICES; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:.
Section 1: That the City Council of the City of Baytown,
Texas, hereby approves an amendment to the contract with the
Baytown Area /West Chambers County Economic Development Foundation
and authorizes and directs the Mayor and City Clerk of the City
of Baytown to execute and attest to said amendment for marina
development services. A -.copy of said amendment is attached
hereto, marked Exhibit "A," and made a part hereof for all
intents and purposes.
Section 2: The City Council hereby authorizes payment of
not more than THIRTY THOUSAND AND N01100 ($30,000.00) DOLLARS to

Foundation to provide marinadevelopment services.
Section 3: This ordinance shall take effect immediately
from and after its passage by the City Council of the City of
Baytown.

AMENDMENT TO ECONOMIC DEVELOPMENT CONTRACT
® THE STATE OF TEXAS :
COUNTY OF HARRIS
THIS AMENDMENT is entered into on the day of July,
1987, by and between the CITY OF BAYTOWN (City) and THE BAYTOWN
AREA /WEST CHAMBERS COUNTY ECONOMIC DEVELOPMENT FOUNDATION
(Foundation).
W I T N E S S E T H:
WHEREAS, the City and the Foundation entered into a contract
on the 26th day of January, 1987, whereby the Foundation agreed
to provide or cause to be provided economic development services
within the Baytown West /Chambers County area; and
WHEREAS, the parties now desire to amend said agreement to
include the development of a marina for the Baytown area as one
of the services to be provided by the Foundation under the terms
of the above described contract; NOW THEREFORE,
For and consideration of the premises and mutual covenants
herein contained, it is agreed as follows:
Section 1: In addition to the services to be provided by
the Foundation as set forth in the contract between the City and
the Foundation, the Foundation hereby further agrees to provide
development assistance in the planning and development of a
marina for the City of Baytown. Such development services shall
include the development of a basic design for a marina, and the
employment of a consultant who shall acquire for the City the

permits from the U. S. Army Corps of Engineers that are necessary
for the planning and construction of a marina. The proposed
marina site shall be adjacent to existing Bayland Park within the
City of Baytown, Texas.
Section 2: In consideration for the services to be provided
by the Foundation under this amendment, the City hereby agrees to
pay the actual costs of the Foundation in providing the above
described services, up to but not exceeding the amount of THIRTY
THOUSAND AND N01100 ($30,000.00) DOLLARS. The City shall make
payments monthly, upon receipt from the Foundation of certified
copies of the expenses incurred by the Foundation in providing
the above described services.
Section 3: It is specifically agreed by the parties that if
the time necessary to provide the services required by this
amendment extends beyond the expiration of the original economic
development contract between the City and the Foundation, the
provisions of this amendment shall continue until such time as
the necessary U. S. Corps of Engineers' permits are received or
until this amendment is cancelled by written notice from either
party.
Section 4: This amendment only adds additional services and
consideration to the basic economic development contract that was
entered into between the parties on the 26th day of January,
1987, and the provisions, __.commissions, and agreements of that
basic contract remain in full force and effect. This amendment
should be read as a part of and in conjunction with the terms and
conditions of that basic agreement.
