Ordinance No. 4,68070326-4 ORDINANCE NO. 4680 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, DECLARING THE NEED TO PROTECT PUBLIC HEALTH AND ® SAFETY, AUTHORIZING THE PAYMENT OF THE SUM OF THREE THOUSAND NINETY AND N01100 ($3,090.00) DOLLARS TO EJECTOR SYSTEMS, INC. FOR THE RENTAL OF PNEUMATIC PUMPING AND CONTROL EQUIPMENT; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. WHEREAS, the unexpected discovery of underground gasoline in the Bayway Drive /Baker Road area required the rental of special pneumatic pumping and control equipment in order to protect the public health and safety of the citizens of Baytown; WHEREAS, TEX.REV.CIV.STAT., art. 2368a provides that in case of procurements for the protection of public health or safety, the requirement for competitive bids is not applicable; and WHEREAS, the special pneumatic pumping and control equipment has been supplied by Ejector Systems, Inc. and can be rented from them for long term use; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby declares that due to the need to protect public health and safety, competitive bids are not necessary. Section 2: That payment to Ejector Systems, Inc. of the sum of THREE THOUSAND NINETY AND N01100 ($3,090.00) DOLLARS for three months rent is hereby authorized. Section 1: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
