ORDINANCE NO. 4680
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, DECLARING THE NEED TO PROTECT PUBLIC HEALTH AND
® SAFETY, AUTHORIZING THE PAYMENT OF THE SUM OF THREE
THOUSAND NINETY AND N01100 ($3,090.00) DOLLARS TO
EJECTOR SYSTEMS, INC. FOR THE RENTAL OF PNEUMATIC
PUMPING AND CONTROL EQUIPMENT; AND PROVIDING FOR THE
EFFECTIVE DATE HEREOF.
WHEREAS, the unexpected discovery of underground gasoline in
the Bayway Drive /Baker Road area required the rental of special
pneumatic pumping and control equipment in order to protect the
public health and safety of the citizens of Baytown;
WHEREAS, TEX.REV.CIV.STAT., art. 2368a provides that in case
of procurements for the protection of public health or safety,
the requirement for competitive bids is not applicable; and
WHEREAS, the special pneumatic pumping and control equipment
has been supplied by Ejector Systems, Inc. and can be rented from
them for long term use; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the City Council of the City of Baytown,
Texas, hereby declares that due to the need to protect public
health and safety, competitive bids are not necessary.
Section 2: That payment to Ejector Systems, Inc. of the sum
of THREE THOUSAND NINETY AND N01100 ($3,090.00) DOLLARS for three
months rent is hereby authorized.
Section 1: This ordinance shall take effect immediately
from and after its passage by the City Council of the City of
Baytown.
INTRODUCED, READ and PASSED by the affirmative vote of the
City Council of the City of Baytown, this the 26th day of March,
1987.
