ORDINANCE NO. 4676
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, DECLARING THAT AN EMERGENCY SITUATION EXISTS,
AUTHORIZING THE PAYMENT OF THE SUM OF FOUR THOUSAND TWO
HUNDRED SEVEN AND 44/100 ($4,207.44) DOLLARS TO HARRELL
® MACHINERY, INC. FOR THE REPAIR OF A JOHN DEERE 450C
DOZER, #2 -22; AND PROVIDING FOR THE EFFECTIVE DATE
HEREOF.
WHEREAS, the John Deere 450C Dozer, #2 -22 has suffered
damage and needs to be repaired; and
WHEREAS, TEX. REV. CIV. STAT., art. 2368a provides that in
case of unforeseen damage to public equipment, the requirement
for competitive bids is not applicable; and
WHEREAS, informal bids for the repair of the dozer have been
obtained, and Harrell Machinery, Inc. is the lowest and best
bidder; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the City Council of the City of Baytown,
Texas, hereby declares that an emergency situation exists.
Section 2: That payment to Harrell Machinery, Inc. of the
sum of FOUR THOUSAND TWO HUNDRED SEVEN AND 44/100 ($4,207.44)
DOLLARS is hereby authorized.
Section 3: This ordinance shall take effect immediately
from and after its passage by the City Council of the City of
Baytown.
INTRODUCED, READ, and PASSED by the affirmative vote of the
City Council of the City of Baytown, this the 12th day of March,
1987.
