Ordinance No. 4,67370312 -13 ORDINANCE NO. 4673 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, DECLARING THAT AN EMERGENCY SITUATION EXISTS, AUTHORIZING THE PAYMENT OF THE SUM OF TWO THOUSAND EIGHT HUNDRED NINETY -NINE AND N01100 ($2,899.00) DOLLARS TO NAYLOR SUPPLY FOR THE RENTAL OF A TWELVE INCH (12 ") PUMP ® WITH A DISCHARGE HOSE; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. WHEREAS, the unexpected need to move a line at the Central District Wastewater Treatment Plant requires the diversion of flow from the lift station, and necessitates the rental of a twelve inch (12 ") pump and discharge line to safely divert the flow, thus keeping the sanitary sewer system in operation and protecting public health; and WHEREAS, TEX. REV. CIV. STAT., art. 2368a provides that in case of procurements for the protection of public health, the requirement for competitive bids is not applicable; and WHEREAS, informal bids for the rental of a twelve inch (12 ") pump with a discharge hose have been obtained, and Naylor Supply is the low bidder; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby declares that an emergency situation exists. Section 2: That payment to Naylor Supply of the sum of TWO THOUSAND EIGHT HUNDRED NINETY -NINE AND N01100 ($2,899.00) DOLLARS is hereby authorized. Section 3: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
