Ordinance No. 4,65370212 -14 ORDINANCE NO. 4653 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, DECLARING THAT AN EMERGENCY SITUATION EXISTS, AUTHORIZING THE PAYMENT OF THE SUM OF TWO THOUSAND NINETY -SEVEN AND N01100 ($2,097.00) DOLLARS TO BAY TEMPERATURE CONTROL, INC. FOR THE REPLACEMENT OF THE FURNACES AT STERLING MUNICIPAL LIBRARY; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. WHEREAS, the furnaces at Sterling Municipal Library have quit functioning and need to be replaced; and WHEREAS, TEX. REV. CIV. STAT., art. 2368a provides that in case of unforeseen damage to public equipment, the requirement for competitive bids is not applicable; and WHEREAS, informal bids for the replacement of the furnaces have been obtained, and Bay Temperature Control, Inc. is the lowest and best bidder; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, is Texas, hereby declares that an emergency situation exists. Section 2: That payment to Bay Temperature Control, Inc. of the sum of TWO THOUSAND NINETY -SEVEN AND N01100 ($2,097.00) DOLLARS is hereby authorized. Section 3: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
