Ordinance No. 4,62670122 -5 ORDINANCE NO. 4626 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, DECLARING THAT AN EMERGENCY SITUATION EXISTS, ® AUTHORIZING THE PAYMENT OF THE SUM OF FOUR THOUSAND THREE HUNDRED SIXTY -NINE AND 84/100 ($4,369.84) DOLLARS TO LARRY'S TRUCK & EQUIPMENT SERVICE, INC. FOR THE REPAIR OF FIRE DEPARTMENT PUMPER, UNIT 30; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. WHEREAS, a Fire Department's 1967 Mack 1000 Gallon per Minute Pumper, Unit 30, has suffered unforeseen damage; and WHEREAS, TEX. REV. CIV. STAT., art. 2368a provides that in case of unforeseen damage to public equipment, the requirement for competitive bids is not applicable; and WHEREAS, informal bids for the repair of this equipment have been obtained, and Larry's Truck & Equipment Service, Inc. is the low bidder; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby declares that an emergency situation exists. Section 2: That payment to Larry's Truck & Equipment Service, Inc. of the sum of FOUR THOUSAND THREE HUNDRED SIXTY - NINE AND 84/100 ($4,369.84) DOLLARS is hereby authorized. Section 3: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
