BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the City Council of the City of Baytown
hereby authorizes and directs the Mayor and City Clerk of the
City of Baytown to execute and attest to an easement to Houston
Lighting and Power Company. A copy of said easement is attached
hereto, marked as Exhibit "A," and made a part hereof for all
intents and purposes.
Section 2: This ordinance shall take effect immediately
from and after its passage by the City Council of the City of
Baytown.
INTRODUCED, READ and PASSED by the affirmative vote of the
City Council of the City of Baytown, this the 22nd day of
January, 1987.

RE: REQUEST FOR TEMPORARY ELECTRIC DISTRIBUTION SERVICE AT
Central District Waste Water Treatment Plant
1709 W. Main, Baytown, Texas
Dear Mr. Taylor:
Permission is hereby granted to Houston Lighting S Power Company
(HL&P) by the City of Baytown to install and maintain a temporary electric line
at the above address, for the purpose of providing electric service to the
Central District Waste Water Treatment Plant. Said temporary electric service
will be needed for approximately 24 months. In the event service is needed for
a period longer than that hereinabove stated, the undersigned shall, at the
request . of HL&P, execute such additional instrument(s) pertaining to such
temporary easement as may be required by HL&P, it being understood that the
provisions hereof, and the temporary easement granted herein, except for the
undersigned's obligation of indemnity as hereinafter provided, shall terminate on
the earlier of (i) the execution of such additional instrument(s) or (ii) removal
of said electric line.
The undersigned hereby agree to indemnify and defend HL&P against any
and all claims, suits, costs, or liabilities arising from any injuries (including
death) or damages suffered by any person, property or corporation arising in
any manner from or out of the installation, presence, operation,. maintenance or
removal of the hereinabove mentioned electric line except when such injuries or
damages result from the sole negligence of HL&P. It is also understood and
agreed that Houston Lighting E Power Company will remove said facilities within
ninety (.90) days after being informed that all electrical services have been
disconnected from this line.

(herein called Grantor, whether one or more), for and in consideration of One Dollar ($1.00) to Grantor paid by Houston Lighting
& Power Company (herein called Grantee, P. O. Box 1700, Houston, Texas 77001), has granted and does, by these presents, grant
unto said Grantee, its successors and assigns, an easement for electric distribution facilities (consisting of all necessary and
desirable equipment and appurtenances) at, below and from ground level upward located on, under, over and across the following
described lands in ......... Harris, ............... County, Texas, to wit:
That certain 6.95 -acre tract of land in the William Scott League, Abstract No. 66,
and being the same property described in a deed dated September 9, 1946, and
recorded in Volume 1506, Page 259 of the Deed Records of Harris County, Texas.
The easement herein granted is ten (10) feet wide, the centerline of which is shown
as a dot -dash line symbol on Sketch No. 586 -233, attached hereto and made a part
hereof, together with unobstructed aerial easements ten (10) feet wide, beginning at
a plane sixteen (16) feet above the ground and extending upwards, located on both
sides of and adjoining said ten !101 foot wide easement.
Grantee shall also have rights of ingress and egress to or from said easement, together with reasonable working space, for the
purposes of erecting, installing, operating, maintaining, replacing, inspecting and removing said electric distribution facilities,
together with the additional right to remove from said easement and land adjoining thereto, all bushes, trees and parts thereof or
other structures which, in the opinion of Grantee, endanger or may interfere with the efficiency, safety and proper operation and
maintenance of said electric distribution facilities.
