Ordinance No. 4,61670108 -1 ~� ORDINANCE NO. 4616 AN ORDINANCE ORDERING THE MUNICIPAL ELECTION TO BE HELD 7 ON THE 4TH DAY OF APRIL, 1987, FOR THE PURPOSE OF ELECTING THREE (3) COUNCILMEN FROM THE RESPECTIVE DISTRICTS NOS. TWO (2), THREE (3), AND SIX (6); AND THE ELECTION OF A MAYOR FROM THE CITY AT LARGE; PROVIDING FOR THE ELECTION OFFICERS; DESIGNATING THE PLACES AND MANNER OF HOLDING•SAID ELECTION; PRESCRIBING THE HOURS; ESTABLISHING THE CENTRAL COUNTING STATION; PROVIDING FOR AN ABSENTEE BALLOT BOARD FOR ABSENTEE BALLOTS; AND PROVIDING FOR THE POSTING AND PUBLICATION OF NOTICE. Pursuant to Article II, Section 12, of the Charter of the City of Baytown and the Texas Election Code, providing for the manner of election and the term of office of the members of the City Council of the City of Baytown, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the regular Municipal Election of the City of Baytown, prescribed in said Section of said Charter of the City of Baytown, and pursuant to Articles 41.001 and 41.031 of the Texas Election Code, shall be held between the hours of seven ® (7 :00) o'clock a.m. and seven (7:00) o'clock p.m. on the 4th day of April, 1987, in said City for the purpose of electing the following members of the City Council. . Section 4: That one Councilman shall be elected from each of the respective Districts Nos. Two (2), Three (3), and Six (6) and a Mayor from the City at large by a majority vote; that said districts are as established, defined and outlined in Ordinance No. 3511 which divided the City of Baytown into six (6) districts of approximately equal population, and was adopted and approved by the City Council of the City of Baytown on the 22nd day of November 1982, and as said Ordinance has been amended. Each Councilman so elected shall be a bona fide resident of the district represented by him; District One (1), Four (4), and Five (5), as established in the aforementioned Ordinance and as thereafter amended, are represented by three holdover Councilmen and none shall be elected at this election from those three districts. Said three councilmen to be elected at this election shall hold office for a period of two (2) years. Section 5: That the qualifications of the members of the City Council shall be as follows: The Mayor and each of the six (6) councilmen shall be citizens of the United States of America and qualified voters of the State of Texas; shall have resided for at least six (6) months next preceding the election within the corporate limits of Baytown, and shall not be in arrears in the payment of any taxes or other liability due the City; and shall meet such other requirements as set forth in Article 141.001 of the Texas Election Code. Section 6: (a) That any eligible and qualified person may have his name printed upon the official ballot as an independent candidate for the office of Councilman from his respective district, by filing his sworn application with the Mayor of the City of Baytown at least forty-five(45) days prior to the date of this election. (b) The form of the sworn application for the candidates for the office of Councilman shall be as set forth by Article 141.031 of the Texas Election Code. (c) Such sworn application may be accompanied with a petition signed by qualified electors, although such petition is not required. ® (d) Such sworn applications for candidates for the office of Councilman shall be accompanied with an executed copy of the "Loyalty Affidavit" as required by the Election Laws of Texas, in substantially the following form: "I, I of Harris County Texas, being a candidate for the office of Councilman, swear E E E u r� L' 70810 -1d that I will support and defend the Constitution and laws of the United States and of the State of Texas." TWO FOR COUNCILMAN DISTRICT NO. THREE FOR COUNCILMAN DISTRICT NO. SIX Section 9: That any person eligible for the office of Councilman or Mayor who has filed his own sworn application in accordance with the provisions of this ordinance shall have his name printed on the official ballot. Any such person may cause his name to be withdrawn at anytime before the official ballots are actually printed by filing, in writing, with the Mayor, a request to that effect over his own signature, duly attested to ® by a Notary Public. No names so withdrawn shall be printed on the ballot. No later than twenty (20) days before the date of the election, the City Clerk shall have the official ballot printed. ® Section 10: Each qualified voter who desires to cast an f� absentee vote and who expects to be absent on the day of the City's General Election, shall be entitled to an official ballot C J n 70108 -1f ® and the right to cast such ballot in accordance with the ® provisions of the Texas Election Code of 1985, as amended. Section 11: The City Council Chamber and Conference Room area in City Hall of the City of Baytown, 2401 Market Street ® is hereby established as the Central Counting Station to receive and tabulate voted ballots. The City Clerk is hereby appointed Manager of the Central Counting Station and also Tabulation Supervisor. Edna Oliver is hereby appointed Presiding Judge for the Central Counting Station, and J. Rodger Read is appointed as Alternate Judge. Section 12: There is hereby created an Absentee Ballot Board which shall count all absentee ballots. Edna Oliver is hereby appointed Presiding Judge of the Absentee Ballot Board, and J. Rodger Read is appointed as Alternate Judge. Section 13: The Mayor is hereby directed to give notice of said election by publishing a copy of the Election Proclamation and Notice in a newspaper of general circulation within said City; said publication to be made no earlier than the thirtieth (30th) day or later than the tenth (10th) day prior to the date of said election. Section 14: This ordinance shall take effect immediately from and after its passage by the City Council of the ® City of Baytown.
