ORDINANCE NO. 4591
MENDING CHAPTER 2 1/2, "ADULT COMMERCIAL
BY AMENDING SECTION 2 1/2 -2,
SECTION 2 1/2 -51 "MASSAGINIST LICENSE,-
ISSUANCE OF A MASSAGINIST LICENSE; AND
THE PUBLICATION AND EFFECTIVE DATE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That Section 2 1/2 -2(a) of the Code of
Ordinances of the City of Baytown, Texas is hereby amended to
read as follows:
Section 2 1/2 -2. Generally.
(a). Licenses issued pursuant to this article
shall be valid, except as otherwise provided herein,
from the date of issuance through December 31st of the
year in which the license is issued. Any license
obtained or certificate required pursuant to this
article shall be posted and kept in a conspicuous place
in the massage establishment. Any license issued
pursuant to this article shall not be assignable to any
other person, firm, corporation or entity.
Section 2: That Section 2 1/2-5(b)(11) of the Code of
Ordinances of the City of Baytown, Texas is hereby amended to
read as follows:
Section 2 1/2 -5. Massaginist license.
(b) (11) . A photostatic copy of certificate of
registration, as a registered massage therapist, issued
by the Texas Department of Health, or such other
certificate providing exemption from licensure under
Tex. Rev. Civ. Stat. Ann., art. 4512K as an exhibit
attached to the application.
Section 3: That Section 2 1/2- 5(b)(12) is added to the Code
of Ordinances of the City of Baytown, Texas, and shall read as
follows:
Section 2 1/2 -5. Massaginist license.
(b) (12) . A recent color photograph of the
applicant as an exhibit attached to the application.
Section 4: All ordinances or parts of ordinances
inconsistent with the terms of this ordinance are hereby
repealed, provided however, that such repeal shall be only to the

extent of such inconsistency and in all other respects this
ordinance shall be cumulative of other ordinances regulating and
governing the subject matter conveyed by this ordinance.
Section 5: If any provision, section, exception,
subsection, paragraph, sentence, clause or phrase of this
ordinance or the application of same to any person or set of
circumstances, shall for any reason be held unconstitutional,
void or invalid, such invalidity shall not affect the validity of
the remaining provisions of this ordinance or their application
to other persons or set of circumstances and to this end all
provisions of this ordinance are declared to be severable.
Section 6: This ordinance shall take effect from and after
ten (10) days after its passage by the City Council. The City
Clerk is hereby directed to give notice hereof by causing the
caption of this ordinance to be published in the official
newspaper of the City of Baytown at least twice within ten (10)
days after the passage of this ordinance.

City Council of the City of Baytown, this the 13th day of
