Ordinance No. 4,54360911. -3 ORDINANCE NO. 4543 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, DECLARING THAT AN EMERGENCY SITUATION EXISTS, AUTHORIZING THE PAYMENT OF THE SUM OF TWO THOUSAND FOUR HUNDRED FIFTY -THREE AND 73/100 ($2,453.73) DOLLARS TO BAYTOWN PNEUMATICS AND HYDRAULICS FOR THE PURCHASE OF A HYDRAULIC PUMP; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. WHEREAS, the hydraulic pump at the brush burning pit has suffered unforeseen damage; and WHEREAS, TEX. REV. CIV. STAT. , art. 2368a provides that in case of unforeseen damage to public equipment, the requirement for competitive bids is not applicable; and WHEREAS, informal bids for the repair of this equipment have been obtained, and Baytown Pneumatics and Hydraulics is the low bidder; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby declares that an emergency situation exists. Section E: That payment to Baytown Pneumatics and Hydraulics of the sum of TWO THOUSAND FOUR HUNDRED FIFTY -THREE AND 73/100 ($2,453.73) DOLLARS is hereby authorized. Section 3: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
