Ordinance No. 4,5406U828-l4 ORDINANCE NO. 4540 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, DECLARING THAT ANY EMERGENCY SITUATION EXISTS, AUTHORIZING THE PAYMENT OF THE SUM OF FIFTEEN THOUSAND ($15,000.00) AND WO1100 DOLLARS TO CDR INDUSTRIES, INC. FOR THE RENTAL OF MECHANICAL DEWATERlNG EQUIPMENT; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. WHEREAS, the rental of mechanical dewatering equipment at the Central Wastewater Treatment Plant is necessary to comply with Texas Water Commission standards; and WHEREAS, TEX. REV. CIV. STAT., ART' 2368a, provides that in the case of procurements necessary to preserve or protect the public health or safety of the Citizens of the City, the requirement for competitive bids is not applicable; and WHEREAS, informal bids for the rental of this necessary equipment have been solicited, and CDR Industries, Inc. is the low estimate; and WHEREAS, the failure to comply with Texas Water Commission standards would result in a possible threat to the public health and safety of the citizens of the City and possible punitive actions by the Texas Water Commission; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby declares that any emergency situation exists' Section 2: That payment to CDR Industries, Inc. of SEVEN THOUSAND FIVE HUNDRED AND N01100 ($7,500.00) DOLLARS, per month for two (2) months as payment for the above described rental of mechanical dewatering equipment is hereby authorized. Section 3: This ordinance shall take effect immediately from and after its passage by the City Council of the City of INTRODUCED, READ, and PASSED by the affirmative vote of the City Council of the City of Baytown, this the 28th day of August, 1986.
