ORDINANCE NO. 4539
AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER
TO EXECUTE AND THE CITY CLERK TO ATTEST TO AN AGREEMENT
WITH THE FAMILY SERVICE CENTER FOR THE OPERATION AND
MAINTENANCE OF AN EMPLOYEE ASSISTANCE PROGRAM FOR CITY
EMPLOYEES AND FAMILIES; AUTHORIZING PAYMENT BY THE CITY
OF FIVE THOUSAND SIX HUNDRED EIGHTY -SEVEN AND NO /100
($5,687.00) DOLLARS; AND PROVIDING FOR THE EFFECTIVE
DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the City Council of the City of Baytown,
Texas, hereby approves an agreement with the Family Service
Center and authorizes the City Manager and City Clerk of the City
of Baytown to execute and attest to said agreement for the
operation and maintenance of an Employee Assistance Program for
City employees and their families. A copy of said agreement is
attached hereto, marked Exhibit "A," and made a part hereof for
all intents and purposes.
Section E: The City Council hereby authorizes payment of
FIVE THOUSAND SIX HUNDRED EIGHTY-SEVEN AND ($5,687.00) DOLLARS to
the Family Service Center for the operation and maintenance of an
Employee Assistance Program for City employees and families.
Section 3: This ordinance shall take effect immediately
from and after its passage by the City Council of the City of
Baytown.
INTRODUCED, READ and PASSED by the affirmative vote of the

CONTRACT FOR EMPLOYEE ASSISTANCE PROGRAM
BETWEEN FAMILY SERVICE CENTER AND THE CITY OF BAYTOWN, TEXAS
This Contract is between the Family Service Center, a Texas
corporation with its principal offices in Houston, Harris County, Texas and
the City of Baytown, Texas, with municipality offices in Baytown, Texas, for
certain services to be performed by the Employee Assistance Program (EAP) of
the Family Service Center (FSC) to permanent employees of the City of Baytown
and their family members.
I. SERVICES
The Services to be provided pu_ uant to this Contract include
the full range of services offered by Family Service Center EAP as follows:
1. Diagnosis and Treatment Planning consisting of up to two (2)
prepaid counseling sessions.
2. Short and long -term counseling sessions will be the
responsibility of the employee.
3. Referral of permanent employees and family members to outside
community resources, including area hospitals for alcohol, drug
and severe psychiatric problems.
4. Supervisory /Management training seminars on a bi- annual basis,
with training materials provided by EAP.
5. Program awareness, by supplying brochures to all permanent
employees explaining the program.
6. Consultation with an EAP representative for permanent employees
and supervisors /managers.
7. Quarterly reports and yearly evaluation by the Employee
Assistance Program.
II. PROCEDURES
An employee will have his initial contact with, and will be referred
to, the Family Service Center Employee Assistance Program. That contact may
be initiated by the employee, a supervisor /manager, or both. A family
member will be referred to the Program by an employee or a supervisor /manager.
When a City of Baytown permanent employee or family member contacts
the Employee Assistance Program, he /she will be directed to the most
convenient District Office location (see APPENDIX I attached hereto), where a
professional counselor will be assigned to assess, treat, and /or refer
him /her. In all instances, the need and /or problem will be addressed. The

goal of the counseling process for an employee will be his effective return to
full productivity.
III. PUBLICITY OF SERVICES
The City of Baytown agrees to inform its employees of this agreement
with FSC and of the services which are available to them, by at least a letter
from management circulated to employees.
Family Service Center Employee Assistance Program agrees to provide
literature in the form of brochures describing the Employee Assistance
Program; in- service training for supervisors /managers of permanent employees;
materials used in training for supervisors /managers of permanent employees;
and other mutually agreed -upon resources.
IV. REPORTING
When the initial contact is a result of a supervisor /manager
referral in regard to job performance concerns, the supervisor /manager will be
told by the EAP counselor: 1) whether the employee has contacted the Employee
Assistance Program, 2) whether treatment goals have been established (without
identification of those goals), and 3) whether there is progress (but not the
nature of that progress) toward treatment goals. All referred employees will
be encouraged to share reports of their progress with their supervisors
voluntarily, if deemed appropriate by the Counselor.
Employees who make their own contacts (self- referrals) with the
Employee Assistance Program will be encouraged to share information with
supervisors /managers if deemed appropriate by the Counselor. No reports will
be made to the company by the Employee Assistance Program concerning
self - referrals other than the quarterly reports described below.
Neither the purpose nor content of the contact by an employee or
family member will be revealed to any representative of the City of Baytown.
The City of Baytown agrees to provide EAP with a list of employees
and their Social Security numbers for verification -of- employment purposes.
EAP will submit quarterly reports to the City of Baytown which will
reflect usage rates and demographic data such as total number of employees and
family members using the Program, problem categories, job categories, length
of employment, sex, marital status, and other related information, provided it
does not violate the confidentiality of the relationship between the EAP and
the employee or family member, or identify that person.

A yearly evaluation will be provided by the Employee Assistance
Program for purposes of evaluating the cost - effectiveness of the program.
Except as provided herein, the identity of the employee or family
member, the nature of the contact, treatment, progress, and prognosis will be
confidential and reported to no one without the written consent of the
employee or family member.
V. CONSULTATION
An EAP representative will be available to permanent employee
supervisor /managers and to permanent employees. The EAP representative may be
called upon to provide on -site or telephone assistance for supervisors or
managers in identifying problems and in preventing minor problems from
becoming more severe. City of Baytown employees or family members may contact
the EAP representative regarding questions about EAP or concerns they may have
about themselves or their family members.
VI. FEE FOR ONGOING COUNSELING
Counseling sessions beyond the two (2) diagnostic sessions for
employees and family members will be the responsibility of the individual
employee. Insurance can be used. EAP will assist employees in filing of
insurance claims.
ATII. RETAINER COST
The annual retainer charged by the Family Service Center Employee
Assistance Program is $10.00 per employee per year, as follows:
Number of City of Baytown permanent employees: 525
Cost per employee per year $ 10.00
Total Contract Cost $5,687.00 (13 months)
The retainer will be paid within thirty days
VIII. TERM OF CONTRACT
The term of this Contract shall be from September 1, 1986 through
September 30, 1987.

IX. MODIFICATION OR TERMINATION OF CONTRACT
This Contract may be modified at any time, only by the mutual,
written consent of the parties hereto. Either party may cancel this Contract
at any time upon 90 -day notice, in writing, to the other party.
