Ordinance No. 4,5146081.4_4 ORDINANCE NO. 4514 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, DECLARING THAT AN EMERGENCY SITUATION EXISTS, AUTHORIZING THE PAYMENT OF THE SUM OF EIGHTEEN THOUSAND EIGHT HUNDRED EIGHTY AND NO /100 ($18,880.00) DOLLARS TO BAY TEMPERATURE CONTROL, INC. FOR THE REPAIR OF THE CITY HALL AIR CONDITIONING SYSTEM; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. WHEREAS, the condensers and one compressor in the City Hall air conditioning system have suffered unforseen damage; and WHEREAS, TEX. REV. CIV. ST.AT., art. 2368a provides that in case of unforeseen damage to public equipment, the requirement for competitive bids is not applicable; and WHEREAS, informal bids for the repair of this public equipment have been solicited, and Bay Temperature Control, Inc. is the low estimate; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby declares that an emergency situation exists. Section 2: That payment to Bay Temperature Control, Inc. of EIGHTEEN THOUSAND EIGHT HUNDRED EIGHTY AND 1\10/100 ($18,880.00) DOLLARS as payment for for the above described repairs to the City Hall air conditioning system is hereby authorized. Section 3: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
