ORDINANCE NO. 4501
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
BAYTOWN, AMENDING SECTION 16 1/2 -2, "MECHANICAL
BOARD - CREATION, MEMBERSHIPS, APPOINTMENTS;" REPEALING
INCONSISTENT PROVISIONS; CONTAINING A SAVINGS CLAUSE; AND
PROVIDING FOR THE EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That Section 16 1/2 -2 (a) of the Code of Ordinances of the City
of Baytown, Texas, is hereby amended to read as follows:
Sec. 16 1/2 -2. Mechanical board- creation, membership, appointments.
(a) There is hereby created a mechanical board, hereafter
referred to as the board, which shall consist of five
(5) members. The members of this board shall be
residents of the city and shall be appointed by the
city council.
Section 2: That Section 16 1/2 -2 (b) of the Code of Ordinances of the City
of Baytown, Texas, is hereby amended to read as follows:
Sec. 16 1/2 -2. Mechanical board - creation, membership, appointments.
(b) The board shall consist of:
Position No. 1: A registered mechanical engineer.
Position No. 2: A licensed mechanical contractor.
Position No. 3: A licensed air conditioning contractor.
Position No. 4: A citizen not in the building industry.
Position No. 5: A general contractor.
Section 3: That Section 16 1/2 -2 (f) of the Code of Ordinances of the City
of Baytown, Texas, is hereby amended to read as follows:
Sec. 16 1/2-2. Mechanical board - creation, membership, appointments.
(f) Any three (3) voting members of the board present shall
constitute a quorum to transact business.
Section 4: All ordinances or parts of ordinances inconsistent with the terms
of this ordinance are hereby repealed, provided however, that such repeal shall be
only to the extent of such inconsistency and in all other respects this ordinance
shall be cumulative of other ordinances regulating and governing the subject matter
covered by this ordinance.
Section 5: If any provision, section, exception, subsection, paragraph,
sentence, clause or phrase of this ordinance or the application of same to any
person or set of circurnstances, shall for any reason be held unconstitutional, void or

invalid, such invalidity shall not affect the validity of the remaining provisions of
this ordinance or their application to other persons or sets of circumstances and to
this end all provisions of this ordinance are declared to be severable.
Section 6: This ordinance shall take effect immediately from and after its
passage by the City Council of the City of Baytown.
INTRODUCED, READ, and PASSED by the affirmative vote of the City
Council of the City of Baytown, this the 10th day of July, 1986.
