Ordinance No. 4,499Published in: THE BAYTOWN SUN Tuesday, July 15, 1986 Wednesday, July 16, 1986 60710 -6 ORDINANCE NO. 4499 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, ESTABLISHING A PRIMA FACIE SPEED LIMIT OF 35 MPH ON STATE HIGHWAY 146 DURING CONSTRUCTION ON STATE HIGHWAY 146; PRESCRIBING A MAXIMUM PENALTY OF TWO HUNDRED AND NO /100 ($200.00) DOLLARS FOR EACH VIOLATION THEREOF; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE HEREOF. WHEREAS, the State Department of Highways and Public Transportation has made it known to the City of Baytown that operations will begin in the near future to begin construction for the Ship Channel Bridge on State Highway 146; and WHEREAS, in the interest of safety, it is desirable to maintain a construction speed zone during the construction period; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the prima facia zone of 35 mph be established on State Highway 146 between 0.588 mile (533 feet) west of Wyoming Street and Black Duck Bay Bridge during construction to be effective when so signed within said zone. Section 2: That necessary signs for posting the herein established speed zones will be furnished, installed, and maintained by the direction of the State Department of Highways and Public Transportation Engineer in charge of this project. Section 3: Any person who shall violate any provision of this ordinance shall be deemed guilty of a misdemeanor and upon conviction shall be punished by a fine of not less than One and NO /100 ($1.00) Dollar nor more than Two Hundred and NO/100 ($200.00) Dollars except minors who have passed their 14th birthday but have not reached their 17th birthday shall be punished by a fine of not more than One Hundred and NO /100 ($1U0.00) Dollars. Section 4: This Ordinance shall take effect from and after ten (10) days from its passage by the City Council. The City Clerk is hereby directed to give notice hereof by causing the caption of this ordinance to be published in the official newspaper of the City of Baytown at least twice within ten (10) days after the passage of this ordinance.
