Ordinance No. 4,495Published in: THE BAYMIh1N SUN 60710- -2 Tuesday, July 15, 1986 Wednesday, July 16, 1986 ORDINANCE NO. 4495 AN ORDINANCE ESTABLISHING A PRIMA FACIE SPEED LIMIT OF 5U MILES PER HOUR FOR MOTOR VEHICLES ON A PORTION OF SPUR 330 (DECKER DRIVE) BETWEEN ROLLINGBROOK DRIVE AND WADE ROAD; REPEALING ORDINANCES INCONSISTENT HEREWITH; CONTAINING A SAVINGS CLAUSE; PRESCRIBING A MAXIMUM PENALTY OF TWO HUNDRED AND NO /100 ($200.00) DOLLARS; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the prima facie maximum speed limit with respect to Spur 330 (Decker Drive), between Rollingbrook Drive and Wade Road, is established at 50 miles per hour; and City Council hereby determines and declares this prima facie speed limit to be reasonable and prudent. IF Section 2: That necessary signs for posting the herein established speed zones will be furnished, installed, and maintained by the direction of the State Department of Highways and Public Transportation District Engineer. Section 3: It shall be unlawful for a driver of a vehicle to disobey the instructions of the signs placed in accordance with the provisions of this ordinance, unless at the time otherwise directed by a police officer or traffic control signal. Section 4: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed, provided however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 5: if any provision, section, exception, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end ail provisions of this ordinance are declared to be severable. Section 6: Any person who shall violate any provision of this ordinance shall be deemed guilty of a misdemeanor and upon conviction shall be punished by a fine of not less than One and NO /100 ($1.00) Dollar nor more than Two Hundred 60710 -2a and NO /100 ($200.00) Dollars except minors who have passed their 14th birthday but have not reached their 17th birthday shall be punished by a fine of riot more than One Hundred and NO /100 ($100.00) Dollars. Section 7: This Ordinance shall take effect from and after ten (10) days from its passage by the City Council. The City Clerk is hereby directed to give notice hereof by causing the caption of this ordinance to be published in the official newspaper of the City of Baytown at least twice within ten (10) days after the passage of this ordinance.
