Ordinance No. 4,48760626 -5 ORDINANCE NO. 4487 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, DECLARING THAT AN EMERGENCY SITUATION EXISTS, AUTHORIZING THE PAYMENT OF THE SUM OF TEN THOUSAND AND NO /100 ($10,000.170) DOLLARS TO CDR INDUSTRIES, INC. FOR THE REMOVAL OF EXCESS SOLIDS FROM THE CENTRAL DISTRICT WASTEWATER TREATMENT PLANT; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. WHEREAS, The presence of excess solids in the Central District Wastewater Treatment Plant has resulted in the discharge of excessive pollutants, resulting in additional risk to public health; WHEREAS, TEX. REV. CIV. STAT., art. 2368a provides that when procurements are necessary to preserve or protect public health, the requirement for competitive bids is not applicable; and WHEREAS, informal bids for the removal of these solids has been solicited, and CDR Industries, Inc. is the low estimate; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby declares that an emergency situation exists. Section 2: That payment to CDR Industries, Inc. of TEN THOUSAND AND NO /100 ($10,000.00) DOLLARS as payment for the removal of solids from the Central District Wastewater Treatment Plant is hereby authorized. Section 3: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
